En cas de décès ou de tout dommage corporel d'un passager résultant d'un accident découlant de l'exécution de services de transport par autobus et autocar, et en l'absence de toute autre police d'assurance voyage à laquelle aurait souscrit le passager, la compagnie d'autobus et/ou d'autocars est tenue de verser sans délai, et en tout état de cause dans les quinze jours suivant l'identification de la personne physique ayant droit à une indemnisation, toute avance qui serait nécessaire pour couvrir les besoins économiques immédiats, proportionnellement au préjudice subi, dès lors que des éléments donnent raisonnablement à penser que les causes en sont imputables à la compagnie d'autobus et/ou d'autocars .
1. In the event of the death of, or any personal injury to, passengers, caused by an accident arising out of the operation of bus and coach transport services, and where the passenger is not covered by any other travel insurance policy, the bus and/or coach undertaking shall without delay, and in any event within fifteen days of the establishment of the identity of the natural person entitled to compensation, make such advance payments as may be required to meet immediate economic needs on a basis proportional to the damage suffered, provided that there is prima facie evidence of causality attributable to the transport undertaking .

In accordance with this Chapter, bus and/or coach undertakings shall be liable for the loss or damage resulting from the death of, or personal injury to, passengers, caused by accidents arising out of the operation of bus and coach transport services and occurring while the passenger is in, entering or leaving the vehicle.
