1. An EU trade mark court hearing an action referred to in Article 124 other than an action for a declaration of non-infringement shall, unless there are special grounds for continuing the hearing, of its own motion after hearing the parties or at the request of one of the parties and after hearing the other parties, stay the proceedings where the validity of the EU trade mark is already in issue before another EU trade mark court on account of a counterclaim or where an application for revocation or for a declaration of invalidity has already been filed at the Office.

Urges the Commission pursuant to Article 274 of the EC Treaty, where it contributes substantially to the budgets of organisations, to take the appropriate measures to safeguard the Community's financial interests including if necessary and feasible the adoption and operation by the beneficiary of rules and procedures which can guarantee proper administration and internal control; urges the OHR to cooperate optimally; notes with approval the recent introduction of systematic ex post audits of the implementation of project grants to beneficiaries which are not international organisations; calls on the Commission, at the beginning of each discharge procedure, to provide the European Parliament with an overview and evaluation of all ex post audits performed; undertakes in connection with the forthcoming discharge procedure to investigate whether the agreement of 9 August 1999 between the EU and the UN provides adequate guarantees of proper administration and financial control;
