Le statut des fonctionnaires et le régime applicable aux autres agents de l’Union européenne, fixés par le règlement (CEE, Euratom, CECA) no 259/68 du Conseil (11) (ci-après dénommés «statut» et «régime»), ainsi que les règles adoptées conjointement par les institutions de l’Union aux fins de l’application du statut et du régime, sont applicables au personnel de l’entreprise commune Clean Sky 2.

The Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union as laid down by Council Regulation (EEC, Euratom, ECSC) No 259/68 (11) (‘Staff Regulations’ and ‘Conditions of Employment’) and the rules adopted jointly by the institutions of the Union for the purpose of applying Staff Regulations and Conditions of Employment shall apply to the staff of the Clean Sky 2 Joint Undertaking.

The Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union as laid down by Council Regulation (EEC, Euratom, ECSC) No 259/68 (10) (hereinafter ‘Staff Regulations’ and ‘Conditions of Employment’) and the rules adopted jointly by the institutions of the Union for the purpose of applying Staff Regulations and Conditions of Employment shall apply to the staff of the IMI2 Joint Undertaking.

18. remarque que 2011 était la deuxième année complète d'application du nouveau statut des députés et du statut des assistants (entrés en vigueur, tous les deux, le 14 juillet 2009); constate que les mesures d'application du statut des assistants ont été modifiées à quatre reprises durant ces deux années, pour la mise en œuvre du titre VII du régime applicable aux autres agents de l'Union européenne et de ses mesures d'application, sur la base de propositions du groupe temporaire d'évaluation et du secrétaire général; rappelle que l'application du titre VII du régime applicable aux autres agents de l'Union européenne a produit un système unique régissant le statut des assistants parlementaires accrédités, qui œuvrent sur les trois lieux de travail du Parlement, en se substituant à vingt-sept systèmes nationaux de relations contractuelles, de fiscalité et de sécurité sociale, et que rien n'indique pour l'instant qu'il faille adapter les règles s'appliquant aux assistants parlementaires dans ledit titre VII; suggère qu'il soit procédé à une évaluation complète du statut des assistants, y compris des ajustements éventuels du règlement, avant les prochaines élections européennes;

Points out that 2011 was the second full year in which the new Statute for Members and the Statute for Assistants has been in force (both effective as of 14 July 2009); notes that the Implementing Measures for the Statute for Assistants have been amended four times in those two years for the application of Title VII of the Conditions of Employment of Other Servants of the European Union (CEOS) and the Implementing Measures on the basis of proposals from the Temporary Evaluation Group and the Secretary-General; recalls that the implementation of Title VII of the CEOS created a single scheme governing the status of accredited parliamentary assistants (APAs) working in Parliament's three working places, which replaced twenty-seven different national systems of contractual relationships, taxation and social security and that currently there is no evidence that would suggest a need to adapt the rules applying to parliamentary assistants contained in Title VII of the CEOS; suggests a full evaluation of the Statute of Assistants including possible adaptations of the rules before the next European elections;

The rules of these bodies may deviate from the Staff Regulations insofar as the acts establishing these bodies according to Art. 1a(2) of the Staff Regulations do not foresee an application of the Staff Regulations.

Notes that 2009 was the first year of implementation for the Statute for Members of the European Parliament and for the Statute for Accredited Parliamentary Assistants; observes a certain number of initial problems with the implementing measures for the Assistants' Statute, welcomes however the fact that a Temporary Evaluation Group, set up within the Bureau, on the Members' and Assistants' Statutes has proposed amendments to the implementing measures for the Members' Statute concerning (i) Members' travel, (ii) Members' sickness insurance and reimbursement of medical expenses, (iii) travel by assistants on mission, (iv) duration and renewal of assistants' contracts, (v) assistants' professional training, and (vi) rules concerning Members' trainees as well as other amendments to the Assistants' Statute, in particular on (i) use of the parliamentary assistance and general expenditure allowances, (ii) paying agents, and (iii) revision of the complaints and appeals procedure for Members; stresses that these amendments should be implemented at the latest by 30 November 2011;

The Staff Regulations of Officials of the European Communities and the Conditions of Employment of Other Servants of the European Communities laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (12) (the Staff Regulations) and the rules adopted jointly by the Union's institutions for the purpose of applying these Staff Regulations and Conditions of Employment shall apply to the staff of the Support Office, including the Executive Director.

Le directeur d’Europol, ses directeurs adjoints et son personnel engagés après la date d’application de la présente décision sont soumis au statut des fonctionnaires des Communautés européennes et au régime applicable aux autres agents des Communautés européennes (ci-après dénommés respectivement «statut» et «RAA») fixés dans le règlement (CEE, Euratom, CECA) no 259/68 du Conseil (14), ainsi qu’aux modalités d’application du statut et du RAA adoptées conjointement par les institutions des Communautés européennes.

The Staff Regulations of officials of the European Communities and the Conditions of employment of other servants of the European Communities (hereinafter referred to as the Staff Regulations and the Conditions of employment respectively) laid down in Regulation (EEC, Euratom, ECSC) No 259/68 of the Council (14) and the rules adopted jointly by the institutions of the European Communities for the purpose of applying the Staff Regulations and the Conditions of employment shall apply to the Director, the Deputy Directors and to the Europol staff engaged after the date of application of this Decision.

3. Le directeur est soumis au statut des fonctionnaires des Communautés européennes et au régime applicable aux autres agents de ces Communautés, fixés par le règlement (CEE, Euratom, CECA) no 259/68 du Conseil (ci-après dénommé «statut») ainsi qu'aux règles adoptées conjointement par les institutions des Communautés européennes aux fins de l'application dudit statut, sauf indication contraire des présents statuts.
3. The Director shall be subject to the Staff Regulations of officials of the European Communities and the Conditions of Employment of other servants of the European Communities, laid down by Regulation (EEC, Euratom, ECSC) No 259/68 (the Staff Regulations) as well as the rules adopted jointly by the institutions of the European Community for the purposes of the application of those Staff Regulations save as otherwise provided in these Statutes.
