Le 4 décembre 2015, le comité d'analyse socio-économique de l'Agence (CASE) a adopté un avis indiquant que la restriction proposée dans le dossier annexe XV, telle qu'elle est modifiée par le CER et le CASE, est la mesure la plus appropriée à l'échelle de l'Union pour prévenir les risques identifiés eu égard à ses avantages et coûts socio-économiques.

Pursuant to the conclusion of RAC that the available data did not allow quantification of the dose-response relationship for the health effects of BPA, the Agency's Committee for Socio-Economic Analysis (‘SEAC’) could not use the benefit estimates in the French dossier and therefore performed a break-even analysis, on the basis of which it concluded that overall the estimated costs outweigh the potential health benefits of the proposed restriction.

Dans son avis, le CASE estime que la restriction, telle que modifiée par le CER, est la mesure la plus appropriée à l’échelle de l’Union, en termes de proportionnalité des avantages et des coûts socio-économiques, pour faire face aux risques identifiés.

9. Sans préjudice des obligations qui incombent aux États membres au titre de l'article 7 de la directive 91/440/CEE, lorsqu'un État membre estime, après avoir présenté une analyse socio-économique, que la mise en place d'un corridor de fret ne serait pas dans l'intérêt des candidats susceptibles de l'utiliser ou n'apporterait pas de bénéfices socio-économiques significatifs ou représenterait une charge disproportionnée, l'État membre concerné n'est pas obligé de participer à sa mise en place comme indiqué aux paragraphes 4 et 6 du présent article, sous réserve d'une décision de la Commission statuant conformément aux actes délégués visés aux articles 20, 21 et 22.
9. Without prejudice to the obligations of Member States under Article 7 of Directive 91/440/EC, where a Member State considers, after having provided a socio-economic analysis, that the establishment of a freight corridor would not be in the interest of the applicants likely to use the freight corridor or would not bring significant socio-economic benefits or would cause a disproportionate burden, the Member State concerned shall not be obliged to participate as referred to in paragraphs 4 and 6 of this Article, subject to a decision of the Commission acting in accordance with the delegated acts referred to in Articles 20, 21 and 22.
