Le règlement (CE) no 1257/1999 du Conseil du 17 mai 1999 concernant le soutien au développement rural par le Fonds européen d'orientation et de garantie agricole (FEOGA) et modifiant et abrogeant certains règlements et le règlement (CE) no 1698/2005 du Conseil du 20 septembre 2005 concernant le soutien au développement rural par le Fonds européen agricole pour le développement rural (Feader)de garantie agricole (FEOGA) et modifiant et abrogeant certains règlements ont introduit des règles spécifiques applicables aux aides d'État accordées pour certaines mesures de développement rural bénéficiant du soutien de l'État membre sans intervention de la Communauté.
Council Regulation (EC) No 1257/1999 of 17 May 1999 on support for rural development from the European Agricultural Guidance and Guarantee Fund (EAGGF) and amending and repealing certain Regulations and Council Regulation (EC) No 1698/2005 of 20 September 2005 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) have introduced specific State aid rules for certain rural development measures receiving Member State support without any Community financing.

Par conséquent, contrairement à l'approche adoptée dans le règlement (CE) no 1/2004 de la Commission du 23 décembre 2003 concernant l'application des articles 87 et 88 du traité aux aides d'État accordées aux petites et moyennes entreprises actives dans la production, la transformation et la commercialisation de produits agricoles , il semble utile de prévoir un règlement d'exemption orienté vers les besoins spécifiques de la production agricole primaire.
Consequently, and contrary to the approach taken in Commission Regulation (EC) No 1/2004 of 23 December 2003 on the application of Articles 87 and 88 of the EC Treaty to State aid to small and medium-sized enterprises active in the production, processing and marketing of agricultural products , it appears useful to set up an exemption regulation targeted at the specific needs of primary agricultural production.
