Emphasises the fact that the review of the consumer acquis should lead to a more coherent legal framework for consumers' rights; recalls its preference for the adoption of a mixed approach, i.e. a horizontal instrument with the primary goal of ensuring the coherence of existing legislation and enabling loopholes to be closed by grouping together, in consistent law, cross-sectoral issues common to all directives; considers that specific questions should continue to be considered separately in the sectoral directives; the long established principles of consumer rights should also be applied in the digital world; urges, in the context of the review of the aquis, more steps to be taken to ensure consumer protection, including privacy and security, in the digital world, without, however, putting an additional and unjustified burden on industry;

64. The existence of such a regulation could lead to the disappearance of almost all the sums owing to the Community in the wake of the adulterated butter affair and the irregularities identified in 1993 - as of 2003 and, at the latest, 2007 - without the fraudsters being punished or the European taxpayer being reimbursed for the improperly advanced sums.

Furthermore, upon opposition by the proprietor of an earlier trade mark within the meaning of paragraph 2, or of an earlier Community or geographical indication, the trade mark applied for shall not be registered where it is identical with or similar to the earlier trade mark or geographical indication and is to be registered for goods or services which are not similar to those for which the earlier trade mark or geographical indication is registered, where, in the case of an earlier Community trade mark or geographical indication, the trade mark or geographical indication has a reputation in the Community and, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the trade mark applied for would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark or geographical indication ".

Furthermore, upon opposition by the proprietor of an earlier trade mark within the meaning of paragraph 2, the trade mark applied for shall not be registered where it is identical with or similar to the earlier trade mark and is to be registered for goods or services which are not similar to those for which the earlier trade mark is registered, where in the case of an earlier Community trade mark or geographical indication the trade mark has a reputation in the Community and, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the trade mark applied for would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark".

(1) considérant que le régime du transit externe tel que régi par le règlement (CEE) n° 2913/92 du Conseil du 12 octobre 1992 établissant le code des douanes communautaire(4) est principalement destiné à faciliter les échanges de marchandises non communautaires sur le territoire douanier de la Communauté; que la nécessité du recours à ce régime en liaison avec l'exportation de marchandises communautaires doit être évaluée par rapport à des situations très variées; qu'il convient, en tout état de cause, d'éviter que les produits qui font l'objet ou bénéficient de mesures à l'exportation ne puissent, selon le cas, échapper à ces mesures ou en bénéficier indûment en veillant à ce que la réglementation douanière communautaire prise dans son ensemble garantisse une surveillance et un suivi au moins équivalents à ceux offerts par le transit communautaire externe; que, tout en maintenant la possibilité de recourir à ce régime dans certaines de ces situations, il est opportun de confier leur définition à la procédure du comité;
(1) Whereas the external transit procedure as governed by Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code(4) is primarily designed to facilitate trade in non-Community goods in the Community customs territory; whereas the need for recourse to that procedure for the export of Community goods must be evaluated in relation to very different situations; whereas it is necessary, in any case, to prevent products covered by or benefiting from export measures from either evading or benefiting unjustifiably from such measures, by ensuring that the Community customs legislation taken as a whole guarantees control and monitoring at least equivalent to that offered by the external community transit procedure; whereas, if the possibility to use this procedure in some of those situations is maintained, definition of such situations should be a matter for the committee procedure;

3. A trade mark shall furthermore not be registered or, if registered, shall be liable to be declared invalid if it is identical with, or similar to, an earlier Community trade mark within the meaning of paragraph 2 and is to be, or has been, registered for goods or services which are not similar to those for which the earlier Community trade mark is registered, where the earlier Community trade mark has a reputation in the Community and where the use of the later trade mark without due cause would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the ea4.
