Afin de protéger comme il convient les fonds de l'Union de la corruption ou du détournement, la définition de la notion d'agent public doit donc couvrir les personnes qui ne sont pas investies d'un mandat officiel mais qui, néanmoins, de manière similaire, sont chargées d'une fonction de service public en liaison avec des fonds de l'Union, et exercent une telle fonction, comme les contractants participant à la gestion de ces fonds.
In order to protect Union funds adequately from corruption and misappropriation, the definition of ‘public official’ therefore needs to cover persons who do not hold formal office but who are nonetheless assigned and exercise, in a similar manner, a public service function in relation to Union funds, such as contractors involved in the management of such funds.
