TRADUCTIONS EN CONTEXTE

Une action doit donc être entreprise pour sensibiliser les autorités judiciaires à l'utilisation de ces nouvelles technologies dans les procédures judiciaires civiles et pénales transfrontières.
Actions must therefore be undertaken to make judicial authorities aware of the use of these new technologies in civil and criminal crossborder judicial proceedings.

En particulier, en ce qui concerne les Fonds structurels, le législateur a décidé que l'action des Fonds structurels et du FEOGA -garantie pour les mesures de développement rural «est complémentaire de celle menée par les Etats membres ou vise à y contribuer» (considérant 27 du règlement (CE) n°1260/1999) et doit donc être considérée comme «des compléments des actions nationales correspondantes ou des contributions à celle-ci» (article 8, paragraphe 1, du règlement (CE) n°1260/1999).
As regards the Structural Funds in particular, the legislator decided that the action of the Structural Funds and the EAGGF Guarantee Section concerning rural development measures should be "complementary to, or intended to contribute to, the action of the Member States" (preamble 27 to Regulation (EC) No 1260/1999) and so should "complement or contribute to corresponding national actions" (Article 8(1) of Regulation (EC) No 1260/1999).

It is therefore necessary to renew the message of the First Action Plan for Innovation in Europe: innovation in the Union is being held back, and Member State and Union-level efforts must be combined to remedy the situation if the Lisbon goal is to be achieved. This is the objective of this Communication.

Ms Bresso stressed that, "Efforts to support economic growth and social cohesion are a responsibility that has to be borne by all public authorities", adding that "the effectiveness of our action and our credibility in the eyes of our fellow citizens depends on this and it is also the key to making the Europe 2020 Strategy a reality, unlike the Lisbon Strategy, which was never anchored in the economic fabric at local and regional level".

Atteindre les objectifs et mettre en oeuvre les actions prévues dans eEurope 2005 sera un défi pour eux (comme d'ailleurs pour les États membres actuels). eEurope 2005 doit donc être caractérisé par une souplesse intrinsèque et il convient de prévoir un réexamen à mi-parcours des actions afin d'intégrer en douceur les nouveaux États membres dans le plan d'action.
It will be a challenge for them (and for the current Member States) to meet the targets and to implement the actions contained in eEurope 2005. eEurope 2005 therefore needs built-in flexibility and should provide for a mid-term review of actions to ensure a smooth phasing in of the new members in the action plan.

Ces notions ne doivent pas être confondues. Subsidiarité et proportionnalité sont des fondements de l'action communautaire : - la Communauté n'intervient que si les objectifs de l'action envisagée ne peuvent pas être réalisés de manière suffisante par les Etats membres et peuvent donc être mieux réalisés au niveau communautaire; - l'action communautaire doit en outre être proportionnelle et donc ne pas excéder ce qui est nécessaire pour atteindre les objectifs.
Subsidiarity and proportionality are among the fundamental principles of Community activity: - the Community takes action only if and in so far as the objectives of the proposed action cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale or effects of the proposed action, be better achieved by the Community; - Community action must be proportionate, that is to say it may not go beyond what is necessary to achieve the objectives of the Treaty.
