Suite à l'entrée en vigueur du TUE le 1er novembre, et compte tenu du fait que les différents avis du Comité des Gouverneurs des BC, du Comité monétaire et du Parlement européen(1) ont été donnés, le Conseil a procédé à l'adoption - des 4 actes suivants : = Règlement relatif à l'application du protocole sur la procédure concernant les déficits excessifs annexé au Traité = Décision relative aux données statistiques à utiliser pour la détermination de la clé de répartition des ressources financières de l'Institut monétaire européen = Décision relative à la consultation de l'Institut monétaire européen par les autorités des Etats membres au sujet de projets de réglementation = Règlement modifiant le règlement n° 260/68, portant fixation des conditions et de la procédure d'application de l'impôt établi au profit des Communautés européennes - de deux positions communes = règlement précisant les définitions en vue de l'application de l'interdiction de l'accès privilégié énoncée à l'article 104 A du Traité = règlement précisant les définitions nécessaires à l'application des interdictions énoncées à l'article 104 et à l'article 104 B paragraphe 1 du Traité pour lesquelles la procédure de coopération s'applique.
Following entry into force of the TEU on 1 November and in view of the fact that the Committee of Governors of the central banks, the Monetary Committee and the European Parliament (1) had given their opinions, the Council proceeded to adopt: (1) The text concerning privileges and immunities, on which the European Parliament has not yet delivered its Opinion, will be adopted later. - the following four acts: = Regulation on the application of the Protocol on the excessive deficit procedure annexed to the Treaty = Decision on the statistical data to be used for the determination of the key for the financial resources of the European Monetary Institute = Decision on the consultation of the European Monetary Institute by the authorities of the Member States on draft legislative provisions = Regulation modifying Regulation No 260/68 which lays down the conditions and procedure for applying the tax for the benefit of the European Communities. - two common positions: = on a Regulation specifying definitions for the application of the prohibition of privileged access referred to in Article 104a of the Treaty = on a Regulation specifying definitions for the application of the prohibitions referred to in Articles 104 and 104b(1) of the Treaty, to which the co-operation procedure applies.

Les principaux caractéristiques des sept projets sont les suivants : - L'interdiction de l'accès privilégié des pouvoirs publics aux institutions financières Le projet de règlement vise à établir notamment les principes suivants concernant l'interdiction d'accès privilégié énoncée à l'article 104 A du Traité : = est considérée comme accès privilégié, non seulement l'obligation d'acquisition ou de détention de titres de la dette publique par des institutions financières, mais aussi les avantages fiscaux ou financiers qui seraient accordés à ces institutions financières, afin de favoriser l'acquisition ou la détention de ces titres ; = les obligations de financement du logement social ne sont pas considérées comme accès privilégié pour autant que les conditions pratiquées en faveur du secteur public s'appliquent aussi au secteur privé.
The main features of the seven draft texts are as follows: - Prohibition on privileged access to financial institutions for the government sector The draft Regulation is designed to establish, amongst other things, the following principles concerning the prohibition on privileged access laid down in Article 104a of the Treaty: = privileged access is deemed to cover not only any obligation on financial institutions to acquire or hold public debt, but also any tax or financial advantages which might be conferred on those financial institutions in order to encourage them to acquire or hold that debt; = obligations to fund social housing are not regarded as privileged access provided that the same terms are applied to the public and private sectors.

That Working Party met on 6 and 8 September and examined the draft relating to the prohibition of privileged access contained in Article 104a of the Treaty and the draft concerning the data to be used for calculating the key for contributions to the financial resources of the European Monetary Institute.

Preparation for the 2nd stage of Economic and Monetary Union The Council, completing in the process the arrangements necessary for the entry into force of the 2nd stage of EMU on 1 January 1994 (see Press Release No 10235/93 - Ecofin Council meeting of 22.XI.1993), adopted the Regulations: - specifying definitions for the application of the prohibition of privileged access referred to in Article 104a of the Treaty; - specifying definitions for the application of the prohibitions referred to in Articles 104 and 104b(1) of the Treaty; - amending Regulation (Euratom, ECSC, EEC) No 549/69 determining the categories of officials and other servants of the European Communities to whom the provisions of Article 12, the second paragraph of Article 13 and Article 14 of the Protocol on the Privileges and Immunities of the Communities apply.
