17. prend acte de l'issue de l'initiative populaire du 9 février 2014 "Contre l'immigration de masse" et des décisions prises le 11 février 2015 par le Conseil fédéral suisse en ce qui concerne la mise en œuvre d'un projet de loi d'exécution et de nouvelles mesures d'accompagnement; fait observer que cela va à l'encontre des obligations qui résultent de l'accord sur la libre circulation des personnes (ALCP) et attend de la Suisse qu'elle respecte ces obligations; fait observer que la question de la migration des citoyens de pays tiers ne devrait pas être confondue avec la libre circulation des personnes, ancrée dans les traités; souligne que les mesures unilatérales prises par la Suisse afin d'éviter la discrimination à l'égard des citoyens croates restent inférieures au protocole visant à étendre l'ALCP pour y inclure la Croatie et que la ratification de ce protocole permettrait également la poursuite et l'élargissement de la participation de la Suisse au programme Horizon 2020 après 2016, afin de promouvoir l'accès des chercheurs aux financements Horizon 2020; demande à la Commission de coopérer avec la Suisse et les États membres pour trouver une solution satisfaisante qui respecte à la fois les dispositions des accords concernés et l'état de droit;
17. Takes note of the outcome of the popular initiative of 9 February 2014 ‘Against Mass Immigration’ and the decisions taken on 11 February 2015 by the Swiss Federal Council in relation to its implementation of a draft implementing law and new flanking measures; points out that this runs counter to obligations stemming from the Free Movement of Persons Agreement (FMPA) and expects Switzerland to respect these obligations; points out that the question of migration of citizens from third countries should not be confused with the free movement of persons as enshrined in the Treaties; stresses that the unilateral measures taken by Switzerland in order to avoid discrimination against Croatian citizens fall short of replacing the ratification of the Protocol extending the FMPA to include Croatia and that ratifying that Protocol would clear the way for Switzerland’s involvement in the Horizon 2020 programme to continue and be extended after 2016 in order to promote researchers’ access to Horizon 2020 funding; calls upon the Commission to work with Switzerland and the Member States to find a satisfactory solution that respects the provisions of the concerned agreements and adhering to the rule of law;

By letter of 4 July 2001 the Council consulted Parliament, pursuant to Article 39(1) of the EU Treaty, on an Initiative of the Kingdom of Sweden with a view to the adoption of a Council Decision determining which provisions of the 1995 Convention on simplified extradition procedure between the Member States of the European Union and of the 1996 Convention relating to extradition between the Member States of the European Union constitute developments of the Schengen acquis in accordance with the Agreement concerning the Republic of Iceland's and the Kingdom of Norway's association with the implementation, application and development of the Schengen acquis (9946/2001 – 2001/0820(CNS)).

4. The Community initiative programmes shall be re-examined following the mid-term evaluation referred to in Article 42 and amended where required on application by the Member State(s) concerned or by the Commission by agreement with the Member State(s).
