Irwin Cotler: With regard to the crisis in Syria: (a) what criteria does the government use to determine (i) whether to intervene, (ii) when to intervene, (iii) the nature and scope of any intervention; (b) who makes the determination in (a) and how; (c) what sources does the government rely upon in determining (a); (d) what legal obligations are considered with respect to (a) and in what ways does the Responsibility to Protect doctrine factor into decision making under (a); (e) in what ways has the government evaluated its obligations under the Responsibility to Protect doctrine with respect to Syria; (f) when were such evaluations done, by whom, and with what outcome; (g) have the criteria by which the government determines its official policy towards the crisis in Syria changed since 2012; (h) when the Minister of Foreign Affairs publicly expressed his support for an indictment of Bashar al-Assad by the International Criminal Court (ICC) in 2012, was this the position of the government and does it remain the position of the government that al-Assad ought to be indicted by the ICC; (j) with respect to Canada’s decision not to sign on to the request of 57 countries made in January, 2013, to ask the Security Council to refer the situation in Syria to the ICC, did Canada support this request; (k) with respect to (j), when, why, how, and by whom were the determinations made in this regard, and when was Canada approached to join in this endeavor and by what means; (l) what criteria were applied in determining whether to support this effort; (m) are there any specific policies or directives within the Department of Foreign Affairs and International Trade that guide decision-making with regard to Canadian intervention in situations of humanitarian crisis; (n) was the decision not to sign the Swiss-led letter asking the United Nations Security Council to refer the situation in Syria to the ICC made by the Minister of Fore ...

26. salue les engagements pris dans la décision 2011/168/PESC du Conseil, adoptée le 21 mars 2011, et dans le plan d'action ultérieur adopté le 12 juillet 2011, et recommande à l'Union et à ses États membres de veiller à leur mise en œuvre par des mesures efficaces et concrètes, en vue de promouvoir l'universalité et l'intégrité du statut de Rome, d'assurer l'indépendance et le fonctionnement effectif et efficace de la CPI et d'appuyer la mise en œuvre du principe de complémentarité; invite le RSUE pour les droits de l'homme à mettre en œuvre les actions concernant la CPI contenues dans le cadre stratégique de l'Union en matière de droits de l'homme et de démocratie;

Welcomes the commitments made in the Council Decision 2011/168/CFSP on the ICC, adopted on 21 March 2011, and the subsequent Action Plan adopted on 12 July 2011, and recommends that the EU and its Member States ensure their implementation through effective and concrete measures to promote the universality and integrity of the Rome Statute, to support the independence of the Court and its effective and efficient functioning and to support the implementation of the principle of complementarity; calls on the EUSR for human rights to implement the actions related to the ICC contained in the EU Strategic Framework on Human Rights and Democracy;

The objective of this Decision is to advance universal support for the Rome Statute of the International Criminal Court (hereinafter the ‘Rome Statute’) by promoting the widest possible participation in it, to preserve the integrity of the Rome Statute, to support the independence of the ICC and its effective and efficient functioning, to support cooperation with the ICC, and to support the implementation of the principle of complementarity.

The European Union reaffirms its determination to encourage the widest possible international support for the ICC through ratification or accession to the Rome Statute and its commitment to support the ICC as a valuable instrument of the world community to combat impunity for the most serious international crimes.

Dans ce contexte et à la lumière de ce qu'on pourrait qualifier de conspiration internationale du silence à l'égard des crimes haineux commis dans le conflit syrien, soit par application du veto, une arme d'obstruction, utilisée par les grands acteurs pour empêcher l'adoption de toute résolution visant à mettre fin à la guerre ou à renvoyer la situation de la Syrie au procureur de la CPI, soit par l'attitude consistant à fermer les yeux sur toutes les atrocités commises par toutes les factions en cause, j'aimerais conclure par un appel au gouvernement du Canada et à toutes les victimes syriennes de viol de guerre ou d'autres formes de violence sexuelle qui vivent au Canada. J'exhorte le gouvernement du Canada à appuyer une campagne internationale destinée à mettre un terme à la culture d'impunité qui protège tous les coupables de viol et d'autres formes de violence sexuelle dans le conflit syrien, soit par des mesures de responsabilisation, soit en tendant la main aux survivants pour les aider directement ou indirectement par l'intermédiaire de groupes de travail régionaux et internationaux.
In view of the above, and in light of what may be called an international conspiracy of silence with respect to the heinous crimes being committed in Syria's conflict, either by the use of veto, a weapon of obstruction, by major players to suppress any resolution to stop the war or to refer the situation of Syria to the prosecutor of the ICC, or by turning a blind eye to all atrocities committed by all the factions involved, l would like to conclude by making an appeal to the Government of Canada and to all Syrian victims of wartime rape and other forms of sexual violence residing in Canada. l appeal to the Government of Canada to support an international campaign to end the culture of impunity that protects those who committed rape and other forms of sexual violence in the Syrian conflict, either through accountability measures or by extending a hand of support to survivors directly or indirectly through regional and international working groups.
