Au cas où la Cour estimerait que le Tribunal a effectué une interprétation correcte de l’arrêt AM S Europe/Commission, précité, et que, par cet arrêt, prononcé en 1982, la Cour avait entendu exclure les communications avec les avocats liés par un rapport d’emploi de la protection au titre du principe de la confidentialité, Akzo et Akcros développent, à titre subsidiaire, un deuxième moyen, qui s’articule autour de deux arguments, chacun étant divisé en deux branches.
Should the Court consider that the General Court has not erred in its interpretation of AM SEurope v Commission, and that, by that judgment pronounced in 1982, it intended to exclude from the benefit of legal professional privilege correspondence with lawyers bound by a relationship of employment, Akzo and Akcros put forward, in the alternative, a second ground of appeal which consists of two arguments, each being divided into two parts.
