IN-CONTEXT TRANSLATIONS

Ce premier Examen des politiques de l'Union européenne et des États membres dans le domaine de l'environnement découle du Conseil européen du printemps 2003 qui prenait note de «l'intention de la Commission de dresser un bilan annuel du processus de Cardiff visant à l'intégration des questions d'environnement, ainsi que de procéder régulièrement à un réexamen de la politique en matière d'environnement et de faire rapport en temps utile pour pouvoir tenir compte des résultats de ces travaux lors de la préparation de son futur rapport de printemps, dès 2004".
This first Review of the European Union and Member States environment policies also follows from the 2003 Spring European Council, which noted "the Commission's intention to carry out an annual stocktaking of the Cardiff process of environmental integration and a regular environment policy review and to report in time for the outcomes of these exercises to be taken into account in the preparation of its future Spring reports, starting in 2004".

Un accord politique sur la directive « responsabilité » est intervenu au Conseil Environnement de juin, ouvrant la voie à l'adoption législative en 2004, conformément aux conclusions du Conseil européen du printemps 2003.
Political agreement on the Liability Directive was reached in the June Environment Council, paving the way for legislative adoption in 2004, consistent with the spring 2003 European Council Conclusions.

Trois mesures ont déjà été adoptées: en octobre 2010, la directive 2010/64/UE du Parlement européen et du Conseil relative au droit à l’interprétation et à la traduction dans le cadre des procédures pénales[2]; en mai 2012, la directive 2012/13/UE du Parlement européen et du Conseil relative au droit à l’information dans le cadre des procédures pénales[3] et, en octobre 2013, la directive 2013/48/UE du Parlement européen et du Conseil relative au droit d’accès à un avocat dans le cadre des procédures pénales et des procédures relatives au mandat d’arrêt européen, au droit d'informer un tiers dès la privation de liberté et au droit des personnes privées de liberté de communiquer avec des tiers et avec les autorités consulaires[4]. Des mesures relatives à la protection des personnes vulnérables soupçonnées ou poursuivies dans le cadre de procédures pénales sont présentées sous la forme d'un paquet législatif, comprenant la présente initiative, ainsi qu’une directive portant renforcement de certains aspects de la présomption d’innocence et du droit d’assister à son procès dans le cadre des procédures pénales, qui font partie des principes fondamentaux qui sous-tendent le droit à un procès équitable.
3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

La présente proposition vise à aligner la procédure de nomination du directeur exécutif de l'Agence européenne pour l'environnement sur les procédures utilisées pour la nomination des directeurs exécutifs des autres agences, comme l'Agence européenne des produits chimiques, l'Agence européenne des médicaments et l'Autorité européenne de sécurité des aliments, en particulier dans le but d'accorder au Parlement européen le droit formel d'auditionner le candidat sélectionné pour le poste par le conseil d'administration de l'Agence européenne pour l'environnement avant sa nomination.

The aim of this proposal is to align the procedure for appointment of the Executive Director of the European Environment Agency with the procedures in use for the Executive Directors of other agencies, such as the European Chemicals Agency, the European Medicines Agency and the European Food Safety Authority, in particular in order to grant the European Parliament the formal right to hear the candidate selected by the Management Board of the European Environment Agency for the post prior to his or her appointment.

(2) The Tampere European Council on 15-16 October 1999 stated, in Item 48 of the Presidency Conclusions, that it was of the opinion that, with regard to national criminal law, efforts to agree on common definitions, incriminations and sanctions should be focused in the first instance on a limited number of sectors of particular relevance, such as environmental crime.

(1a) The European Council on 15-16 October 1999 in Tampere stated in point 48 of the conclusions that it was of the opinion that, with regard to national criminal law, efforts to agree on common definitions, incriminations and sanctions should be focused in the first instance on a limited number of sectors of particular relevance, such as environmental crime.

Le Conseil européen confirme ainsi que la criminalité au détriment de l'environnement constitue l'un des domaines dans lequel un accord doit être trouvé concernant des définitions, incriminations et sanctions communes entre les États membres au niveau du droit pénal national.
In this way, the European Council confirmed that environmental crime is one of the sectors where the Member States should agree common definitions, incriminations and sanctions in the field of national criminal law.

Le refus du Conseil européen d'intégrer la Charte des droits fondamentaux de l'Union dans les Traités fondateurs, de rendre ainsi ces droits juridiquement contraignants et de permettre de cette manière aux citoyens dont les droits n'auraient pas été respectés d'accéder à la Cour de justice européenne, porte atteinte à ce consensus fondamental.
The European Council is violating this fundamental consensus within Europe, by refusing to incorporate the Charter of Fundamental Rights into the Treaties, make it legally binding and denying the citizens, whose rights are being infringed, access to the European Court of Justice.
