TRADUCTIONS EN CONTEXTE

4. se félicite des progrès accomplis en 2015 dans la conclusion d'accords dans le cadre du processus de normalisation des relations entre le Kosovo et la Serbie, notamment les accords sur la création de l'association/communauté des municipalités à majorité serbe du Kosovo, sur l'énergie, sur le pont de Mitrovicë/Mitrovica, celui du 25 août 2015 sur les télécommunications et ceux de juin 2015 sur les assurances automobiles et de février 2015 sur le pouvoir judiciaire; soutient les efforts de médiation tenaces déployés par la vice-présidente de la Commission/haute-représentante de l'Union pour les affaires étrangère et la politique de sécurité (VP/HR) en vue de la normalisation des relations entre la Serbie et le Kosovo, qui n'est pas encore pleinement acquise; invite le service européen pour l'action extérieure à procéder à une évaluation approfondie et globale de l'état de la mise en œuvre de tous les accords conclus à ce jour en ce qui concerne l'adoption des lois sur place et à faire régulièrement rapport à ce sujet au Parlement européen et aux parlements du Kosovo et de Serbie; invite instamment la VP/HR à recenser les lacunes en exigeant des parties qu'elles respectent les engagements pris et appelle la Serbie et le Kosovo à abandonner toute rhétorique négative, à aller de l'avant et à mettre pleinement en œuvre l'ensemble des accords déjà conclus en toute bonne foi et dans le délai imparti ainsi qu'à poursuivre le processus de normalisation avec détermination; souligne qu'un dialogue permanent et constructif entre Pristina et Belgrade et la pleine mise en œuvre des accords conclus sont essentiels à la normalisation de leurs relations;
4. Welcomes the progress made in 2015 in reaching agreements in the framework of the process of normalisation of relations between Kosovo and Serbia, namely on the establishment of the Association/Community of Serb-majority municipalities in Kosovo, on energy and on Mitrovicë/Mitrovica bridge, and including the agreements of 25 August 2015 on telecoms, of June 2015 on vehicle insurance and of February 2015 on the judiciary; supports the continued mediation efforts of the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy (VP/HR) with a view to the normalisation of relations between Serbia and Kosovo, which has yet to be fully achieved; calls on the European External Action Service to make a thorough overall assessment of the state of implementation of all the agreements signed so far with regard to the adoption of laws on the ground, and to report regularly on this to the European Parliament and the parliaments of both Kosovo and Serbia; urges the VP/HR to identify shortfalls and to demand that the parties fulfil their commitments, and calls on Serbia and Kosovo to refrain from negative rhetoric, to move forward in good faith and in a timely manner with the full implementation of all the agreements already reached, and to continue determinedly the normalisation process; stresses that continuous and constructive dialogue between Pristina and Belgrade and the full implementation of the agreements reached are crucial for the normalisation of their relations;

E. considérant que la conclusion de l'accord d'association n'est pas une fin en soi, mais s'inscrit dans le cadre plus vaste de renforcement de la perspective européenne de la République de Moldavie sur les plans économique, politique et social; considérant que l'introduction d'un régime d'exemption de visa pour les citoyens moldaves, la conclusion d'accords dans les domaines de l'aviation, de l'agriculture et de la protection civile, la participation de la République de Moldavie aux agences et programmes de l'Union, la coopération à la politique de sécurité et de défense commune et, plus important encore, la signature de l'accord d'association entre l'Union et la République de Moldavie sont l'expression tangible de ce constat; considérant qu'à cette fin, l'application de l'ensemble des accords est essentielle;
E. whereas the conclusion of the Association Agreement is not an end in itself, but is part of a broader process of enhancing the European perspective of the Republic of Moldova politically, economically and socially; whereas the launch of the visa-free regime for Moldovan citizens, the conclusion of agreements in the areas of aviation, agriculture and civil protection on the participation by the Republic of Moldova in EU agencies and programmes and on common security and defence policy cooperation, and, most importantly, the signature of the EU-Republic of Moldova Association Agreement represent a tangible expression of this process; whereas, to this end, the implementation of all agreements is essential;

26. rappelle que le traité CE prévoit des dérogations pour la négociation et la conclusion d'accords relatifs aux aspects commerciaux de la propriété intellectuelle ayant trait au commerce des services culturels et audiovisuels; souligne que la négociation et la conclusion de ce type d'accords relèvent de la compétence partagée de la Communauté et de ses États membres; attire par ailleurs l'attention sur le fait que, outre une décision de la Communauté adoptée conformément aux dispositions pertinentes du traité CE, la négociation de ce type d'accords requiert l'accord de l'ensemble des États membres et que les accords ainsi négociés doivent être conclus conjointement par la Communauté et par les États membres;
26. Recalls that the EC Treaty includes derogations where the negotiation and conclusion of agreements in the field of commercial aspects of intellectual property relates to trade in cultural and audiovisual services; points out that, in such instances, the negotiation and conclusion of agreements falls within the shared competence of the Community and its Member States; further points out that, in addition to a Community decision taken in accordance with the relevant provisions of the EC Treaty, the negotiation of such agreements requires the common accord of the Member States and agreements negotiated in this way must be concluded jointly by the Community and the Member States;

Certaines questions en suspens concernent la conclusion officielle des arrangements permanents entre l'UE et l'OTAN évoqués plus haut, notamment l'accord qui doit être conclu en vue du déblocage des moyens et possibilités de l'OTAN en faveur de l'UE pour qu'elle puisse mener à bien cette opération, l'approbation et l'adoption du plan de l'opération, la finalisation des accords relatifs à l'état-major, l'approbation du budget de l'opération, la conclusion d'un accord avec les pays tiers qui y participeront, l'échange de correspondance avec l'ancienne république yougoslave de Macédoine liée à cette opération, la conclusion d'un accord sur le statut des forces avec l'ancienne république yougoslave de Macédoine, la conclusion d'accords d'exclusion entre pays membres qui participeront à l'opération, l'échange de correspondance avec l'OSCE liée aux relations avec les observateurs de cette organisation, la décision de l'OTAN sur la fin de l'opération alliée Allied Harmony , la décision du Conseil sur le début de l'opération.
A number of outstanding issues have yet to be completed; the permanent European Union/ΝΑΤΟ arrangements I referred to earlier have to be officially concluded, especially the agreement needed in order to release the NATO assets and capabilities which will be supplied to the European Union so that it can carry out this mission, the operational plan has to be approved and adopted, staffing arrangements have to be completed, the operational budget has to be approved, an agreement has to be concluded with third participating countries, correspondence on the operation needs to be exchanged with the former Yugoslav Republic, an agreement on the status of the forces has to be concluded with the former Yugoslav Republic of Macedonia, exemption agreements between the Member States involved in the operation have to be concluded, correspondence needs to be exchanged with the OSCE about relations with its observers, ΝΑΤΟ has to pass a decision ending the ‘Allied Harmony’ operation and the Council has to pass a decision inaugurating the operation.
