Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

(5) Afin que l'efficacité de ces échanges ne soit pas amoindrie, la possibilité que la transmission d'informations puisse être refusée dans le cas où elle conduirait à divulguer un secret commercial, industriel ou professionnel ou un procédé commercial, ou une information dont la divulgation serait contraire à l'ordre public ne devrait pas s'appliquer aux dispositions concernant l'échange automatique et obligatoire d'informations sur les décisions fiscales anticipées en matière transfrontière et les accords préalables en matière de prix de transfert.
(5) The possibility that the provision of information may be refused where it would lead to the disclosure of a commercial, industrial or professional secret or of a commercial process, or of information whose disclosure would be contrary to public policy should not apply to provisions of mandatory automatic exchange of information on advance cross-border rulings and advance pricing arrangements in order not to reduce the effectiveness of these exchanges.

D’une manière générale, la proposition introduit une série d’améliorations quant à l’échange d’informations, à savoir: une meilleure définition des cas dans lesquels les États membres peuvent réaliser une enquête administrative, ainsi que des mesures pour pallier la non-réalisation d'une enquête; une meilleure définition des conditions relatives à l’échange automatisé d’informations, y compris concernant l’utilisation de formulaires ou de fichiers types, ainsi que l’introduction de l’échange spontané et de l’obligation d’assurer un retour d’information, c’est-à-dire de fournir des informations relatives à l’utilisation des informations transmises par un autre État membre.
In general terms, several improvements are introduced relating to the exchange of information, namely: an improved definition of the cases in which Member States may carry out an administrative investigation, including measures to remedy the failure to carry out an investigation; an improved definition of the conditions for the automatic exchange of information, including the use of standard forms and files as well as the introduction of spontaneous exchange and the obligation to supply feedback, i.e. information on the use made of the information forwarded by another Member State.

The application of the mechanisms established by this Framework Decision only to the transmission of information extracted from criminal records concerning natural persons should be without prejudice to a possible future broadening of the scope of application of such mechanisms to the exchange of information concerning legal persons.

En 2006 et 2007, la Commission a présenté un ensemble complet de mesures législatives composé de trois instruments: la décision-cadre 2008/675/JAI du Conseil obligeant les États membres à prendre en compte les décisions de condamnation antérieures à l’occasion d’une nouvelle procédure pénale; la décision-cadre 2009/315/JAI du Conseil concernant l'organisation et le contenu des échanges d'informations extraites des casiers judiciaires; et la décision 2009/316/JAI du Conseil relative à la création de l’ECRIS comme moyen technique d’échanger des informations extraites des casiers judiciaires[47]. Devant être mises en œuvre au plus tard en avril 2012, les décisions-cadres 2009/315/JAI et 2009/316/JAI du Conseil visent à définir les procédures selon lesquelles un État membre prononçant une condamnation doit transmettre les informations relatives à une nouvelle condamnation à l’État membre ou aux États membres de nationalité de la personne condamnée, à préciser les obligations en matière de stockage et à arrêter un cadre pour un système informatisé d’échange d’informations.
In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
