Étant donné qu'en vertu du point 11 des lignes directrices 2007-2013 l'application des articles 107, 108 et 109 du TFUE aux secteurs couverts par des organisations communes de marché est soumise aux dispositions établies par les règlements concernés, la première condition dont le respect sera analysé sera celle de l'absence d'interférence avec l'organisation commune des marchés.
Considering that under point 11 of the 2007-2013 Guidelines, the application of Articles 107, 108 and 109 TFEU to sectors covered by the common organisations of the market is subject to the provisions of the regulations concerned, the first condition examined will be compliance with non-interference with the common organisation of the market.

Le présent règlement établit les règles relatives à l’applicabilité des articles 81 à 86 et de certaines dispositions de l’article 88 du traité en ce qui concerne la production ou le commerce des produits énumérés à l’annexe I du traité, à l’exception des produits entrant dans le champ d’application du règlement (CE) no 1234/2007 du Conseil du 22 octobre 2007 portant organisation commune des marchés dans le secteur agricole et dispositions spécifiques en ce qui concerne certains produits de ce secteur (règlement “OCM unique”) (17).
This Regulation shall lay down the rules to be applied as regards the applicability of Articles 81 to 86 and certain provisions of Article 88 of the Treaty in relation to production of, or trade in, the products listed in Annex I to the Treaty with the exception of the products covered by Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (17).

Whereas, moreover, the common organization of the market of these products rests to a large extent on the capacity of producers' organizations to promote price regularization, by imposing on their members compliance with the rules they adopt, in order, in accordance with the objectives of the Treaty, to ensure in particular that fishermen enjoy a fair standard of living; whereas the advantage linked to the direct landing by the vessels concerned should not lead, in the areas of activities of producers' organizations, to any jeopardizing of the effectiveness of the measures adopted and implemented by these organizations in the application of the mechanisms of the common organization of the markets; whereas therefore, except where products are intended for processing, it is necessary to make the marketing of catches by fishing vessels flying the flag of, or registered in, a third country subject to such measures;
