For the prosecution of any of the offences referred to in Articles 3 to 7 committed outside the territory of the Member State concerned, as regards paragraph 1(b) of this Article, each Member State shall take the necessary measures to ensure that its jurisdiction is not subordinated to the condition that the prosecution can only be initiated following a report made by the victim in the place where the offence was committed, or a denunciation from the State of the place where the offence was committed.

Exchange of information and intelligence under this Framework Decision may take place concerning offences punishable by the law of the requesting Member State by a custodial sentence or a detention order for a maximum period of at least 12 months and concerning all the offences referred to in Articles 1 to 3 of Council Framework Decision 2002/475/JHA of 13 June 2002 on combating terrorism 1 .

3. Cependant, à titre de dérogation aux règles en matière d'entraide judiciaire visées au paragraphe 2, l'État d'exécution ne peut refuser les demandes visées au paragraphe 1, point a), en invoquant l'absence de double incrimination, si ces demandes concernent les infractions visées à l'article 3, paragraphe 2, et que ces infractions sont punies dans l'État d'émission d'une peine privative de liberté d'au moins trois ans.
3. However, by way of derogation from the rules on mutual assistance referred to in paragraph 2, the executing State may not refuse requests referred to under paragraph 1(a) on grounds of absence of double criminality, where the requests concern the offences referred to in Article 3(2) and those offences are punishable in the issuing State by a prison sentence of at least three years.

2.
