His Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of National Revenue, pursuant to subsection 23(2)Footnote of the Financial Administration Act, hereby remits to each taxpayer, other than a promoter, who has delivered or delivers to the Minister a timely and duly executed agreement letter (referred to in the details of the settlement project regarding general partnerships used as SR & ED tax shelters issued by the Minister on June 30, 1995) accepted by the Minister, amounts payable under the Income Tax Act by the taxpayer equal to (1) the difference between (a) 50% of the product of each payment made before executing the agreement on account of the tax liability resulting from adjustments made by the Minister to the taxpayer’s claim in respect of the tax shelter and the prescribed rate of interest for income tax refunds, for the period from the date of the payment to the date of the assessment of the tax liability made as a result of the agreement, compounded daily, and (b) refund interest in respect of any such payment, (2) 50% of the product of that difference and that rate, for the period from the said date of assessment to the date this Order is implemented, so compounded, and (3) amounts that would not be payable if there were no such refund interest or if this Order were not made.

(34) Since the objectives of this Regulation, namely clarifying and better defining the role of statutory audit regarding public-interest entities, improving the information that the statutory auditor or the audit firm provides to the audited entity, investors and other stakeholders, improving the communication channels between auditors and supervisors of public-interest entities, preventing any conflict of interest arising from the provision of non-audit services to public-interest entities, mitigating the risk of any potential conflict of interest due to the existing system whereby the auditee selects and pays the auditor or the familiarity threat, facilitating the switching of, and the choice of a statutory auditor or an audit firm to public-interest entities, broadening the choice of statutory auditors and audit firms for public-interest entities and improving the effectiveness, independence and consistency of the regulation and oversight of statutory auditors and audit firms providing statutory audits to public-interest entities including as regards cooperation at Union level, cannot be sufficiently achieved by the Member States but can rather, by reason of their scale, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

33. Calls on all EU institutions, bodies, offices and agencies to apply Regulation (EC) No 1049/2001 in a way coherent with the provisions of the Aarhus Convention; calls in that regard on the Commission to make public the conformity-checking studies regarding transposition of EU environmental directives and scientific studies, for example on the impact of biofuels , and calls on the European Chemicals Agency (ECHA) to fully apply Article 119 of Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) with regard to electronic public access, to only accept confidentiality claims that are clearly justified as valid under Article 119(2) of REACH, and to interpret the information that is normally deemed to undermine the protection of commercial interests pursuant to Article 118(2) of REACH strictly and without prejudice to its obligation pursuant to Regulation (EC) No 1049/2001 to balance any granting of confidentiality against a possible overriding public interest on a case-by-case basis;

In accordance with section III, paragraph 19, point (i) of the IGC 2007 Mandate relating to a Protocol on services of general interest which will be annexed to the Treaties, invites the Commission to take initiatives to overcome the legal uncertainty regarding the status of services of general interest, notably the state aid and public procurement rules; welcomes the initiatives of the Commission which aim to clarify ambiguities in the fields of health services and social services of general interest in the Single Market; considers that strong and modern services of general interest are necessary in order to achieve public interest objectives, such as social and territorial cohesion, environmental protection and cultural diversity;
