[7] Article 31(2) of the VIS Regulation provides a derogation from the general principle that data processed in the VIS shall not be transferred or made available to a third country or to an international organisation: certain types of data may be transferred or made available to a third country if necessary in individual cases for the purpose of proving the identity of third-country nationals, including for the purpose of return, and only where specific conditions are met in order to ensure compliance with the requirements of EU data protection.
