La Commission a suivi les travaux du Conseil de l'Europe consacrés à la convention sur la cybercriminalité, qui retient, dans sa version actuelle, quatre catégories d'infractions pénales: 1) infractions contre la confidentialité, l'intégrité et la disponibilité des données et systèmes informatiques, 2) infractions informatiques, 3) infractions se rapportant au contenu et 4) infractions liées aux atteintes à la propriété intellectuelle et aux droits voisins.
The Commission has followed the work of the Council of Europe on the Cybercrime Convention. Four categories of criminal offences are listed in the current draft C.o.E. Cybercrime Convention: 1) Offences against the confidentiality, integrity and availability of computer data and systems; 2) Computer-related offences; 3) Content-related offences; 4) Offences related to infringements of copyright and related rights.

2. 2. Where the terrorist financing referred to in paragraph 1 of this Article concerns any of the offences laid down in Articles 3, 4 and 9, it shall not be necessary that the funds be in fact used, in full or in part, to commit, or to contribute to the commission of, any of those offences, nor shall it be required that the offender knows for which specific offence or offences the funds are to be used.

7. Stresses the Commission’s significant role in assisting with cases raised by petitioners, and calls on it to monitor, in a proactive and timely fashion, certain projects reported by petitioners in which EU law has been, or will in the future be, breached through the implementation of official planning; calls on the Commission, as guardian of the Treaties, to remedy such instances of incorrect transposition of EU law, or of failure to transpose EU law, as have been reported in a large number of petitions filed with Parliament; calls as well on the Commission to be less hesitant in making use of the initiation of infringement proceedings in this regard; emphasises that the impression that greater account is taken of larger Member States when infringement proceedings are initiated must be counteracted; calls on the Commission to keep the Committee on Petitions informed, on a regular basis, of developments in, and of the concrete outcome of, infringement proceedings directly linked to any given petition;

E. considérant que, conformément à l'article 57, paragraphe 2, de la loi constitutionnelle fédérale autrichienne, les membres du Conseil national (Nationalrat) ne peuvent être mis en état d'arrestation, s'ils sont suspectés de la commission d'une infraction pénale, qu'avec l'autorisation du Conseil national – excepté en cas de flagrant délit de commission d'une infraction –; et considérant que les visites domiciliaires chez des membres du Conseil national requièrent une autorisation du Conseil national; considérant que, en vertu de l'article 57, paragraphe 3, de la loi constitutionnelle fédérale autrichienne, une action officielle, en raison d'une infraction punissable, ne peut être intentée à l'encontre d'un membre du Conseil national sans l'autorisation du Conseil national, à moins que ladite infraction soit manifestement sans lien avec l'activité politique du membre concerné et considérant que, conformément à cette disposition, l'autorité concernée doit demander une décision au Conseil national quant à l'existence, ou non, d'un tel lien, si cela est demandé par le membre en question ou par le tiers des membres de la commission permanente compétente;
E. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, Members of the National Council (Nationalrat) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

Calls on the Commission to ensure that infringements of EU law are pursued swiftly by infringement proceedings; calls on the Commission to put in place a fast-track infringement procedure and to consider establishing an independent body within the Commission responsible for prosecuting cases of internal market infringements and pursuing infringement proceedings after obtaining the approval of the College of Commissioners;

Considers that national limitation periods for actions for infringements of the Community competition rules should allow actions to be brought within one year of a decision by the Commission or an NCA finding that those rules have been infringed (or, in the event of an appeal, one year from the conclusion of such appeal); considers that where there is no such decision it should be possible to bring actions for damages for infringements of Article 81 or 82 of the Treaty, the Community competition rules, at any time during the period within which the Commission is entitled to take a decision imposing a fine for those infringements; considers that time should stop running for the period of any formal discussions or mediation between the parties;
