AO. considérant que du 28 au 31 octobre 2013, une délégation de la commission des libertés civiles, de la justice et des affaires intérieures (commission LIBE) du Parlement européen a rencontré, à Washington D.C., le ministère américain du commerce et la commission fédérale du commerce des États-Unis; que le ministère du commerce a reconnu l'existence d'organisations ayant déclaré adhérer aux principes de la «sphère de sécurité», mais dont le statut n'est pas à jour, ce qui signifie qu'elles ne satisfont pas aux exigences de la «sphère de sécurité» alors qu'elles continuent à recevoir des données à caractère personnel provenant de l'Union européenne; que la commission fédérale du commerce a admis la nécessité de réviser les principes de la «sphère de sécurité» afin de les améliorer, surtout en ce qui concerne les mécanismes de plaintes et de résolution alternative des conflits;
AO. whereas on 28-31 October 2013 a delegation of the European Parliament’s Committee on Civil Liberties, Justice and Home Affairs (LIBE Committee) met in Washington D.C. with the US Department of Commerce and the US Federal Trade Commission; whereas the Department of Commerce acknowledged the existence of organisations having self-certified adherence to Safe Harbour Principles but clearly showing a ‘not-current status’, meaning that the company does not fulfil Safe Harbour requirements although continuing to receive personal data from the EU; whereas the Federal Trade Commission admitted that the Safe Harbour should be reviewed in order to improve it, particularly with regard to complaints and alternative dispute resolution systems;

Takes the view that given the increasing importance of e-commerce, data protection standards play an essential role in protecting customers both in the EU and US; stresses that both the EU and the US need to address rising cyber security threats in a concerted manner and in an international context; points out that interoperability and standards in the domain of e-commerce, recognised at global scale, can help to promote more rapid innovation by lowering the risks and costs of new technologies;

R. whereas EU free trade agreements include provisions which pave the way for companies to bid in PPPs via market access and pre-establishment; whereas the treatment and possibilities open in respect of Korea, Colombia/Peru, Central America, Singapore and Canada (and Vietnam and Japan) are defined differently and specifically; whereas there has to be a relatively flexible approach as regards negotiations with different partners; whereas, however, the aim must continue to be to help foster social and economic development, environmental sustainability, democracy and good governance, the observance of human rights and the promotion of internationally recognised standards of protection, as well as the creation of decent jobs; whereas, at the multilateral level, the General Agreement on Trade in Services (GATS) and the Agreement on Government Procurement (GPA) also establish a number of commitments, as may other plurilateral instruments such as the Trade in Services Agreement (TiSA); whereas the environment in the EU is therefore becoming more competitive;

Les participants au Forum à haut niveau sur l’amélioration du fonctionnement de la chaîne d’approvisionnement alimentaire, mis en place par la Commission en 2010, ont eux aussi reconnu l’existence et la nocivité des PCD dans la chaîne d’approvisionnement alimentaire[10]. Reconnaissant la nécessité de traiter le problème au niveau européen, les parties prenantes ont mis en place un cadre d'autoréglementation (la Supply Chain Initiative), que la Commission a saluée et qui, après neuf mois, affiche un bon niveau d'adhésion parmi les entreprises de commerce de détail, de commerce de gros et les entreprises manufacturières, ainsi qu'auprès de certaines PME.
The existence and harmfulness of UTPs in the food supply chain has also been acknowledged by stakeholders in the High Level Forum for a Better Functioning Food Supply Chain, set up by the Commission in 2010.[10] Recognising the need to address the issue at European level, stakeholders set up a self-regulatory framework (the Supply Chain Initiative) which the Commission has welcomed and which after nine months has shown a good uptake among retail, wholesale and manufacturing companies and some SMEs.
