Regrets the Civil Service Tribunal Judgment of 12 December 2013 in Case F-129/12 and deeply regrets the fact that Parliament was condemned for being unable to help APAs in cases of harassment and irregular layoffs; notes the Bureau decision of 14 April 2014 setting up the Advisory Committee for the prevention of mobbing at the workplace, so as to avoid APAs being exposed to this; is concerned, however, about the imbalance in the composition of this committee, which is composed of three Quaestors, one representative of the administration and one APA representative; notes that up to November 2014 at least, in three cases before the committee 'the Quaestors ruled that there were no grounds for further action' ; calls on the Bureau therefore to review its decision regarding the composition of the committee so as to ensure more balanced representation with at least two APA committee members;

11. observe en outre que les comités consultatifs de la Fondation, chargés d'aider le conseil d'administration dans les phases de préparation et d'évaluation des enquêtes, n'ont pas de mandat ni de règlement pour l'organisation de leurs réunions; estime que ces lacunes peuvent mener à une mauvaise compréhension des rôles et des responsabilités des comités consultatifs, entraînant des effets néfastes sur la préparation des enquêtes; demande donc à la Fondation de remédier à cette situation et d'informer l'autorité de décharge des mesures prises à cet égard;

Notes, in addition, that the Foundation's Advisory Committees, responsible for the Governing Board giving input to the preparation and evaluation phases of surveys, do not have Terms of Reference nor Rules of Procedure for the organisation of their meetings; considers that these deficiencies may lead to a misunderstanding of the roles and responsibilities of the Advisory Committees with detrimental effects on the preparation of the surveys; calls therefore on the Foundation to address this situation and inform the discharge authority on the measures taken in this respect;

16. observe que, de juin 2010 à avril 2011, la directrice exécutive de l'Agence a été administratrice et membre du comité consultatif international de Earthwatch, une organisation internationale de défense de l'environnement qui engage des experts qui se consacrent à la recherche scientifique et à l'enseignement, et aurait été membre du comité consultatif européen de Worldwatch Europe; constate que, selon les dires de la directrice exécutive, elle a renoncé aux fonctions qu'elle exerçait au sein d'Earthwatch en avril 2011 sur le conseil du président de la Cour des comptes dans le contexte d'éventuels conflits d'intérêts;

Notes that, from June 2010 until April 2011, the Executive Director of the Agency was a trustee and a member of the International Advisory Board of Earthwatch - an international environmental charity engaging people in scientific field research and education - and was reported to be a member of the European Advisory Board of Worldwatch Europe; acknowledges that, in accordance with the Executive Director's statement, she stepped down from her positions in Earthwatch in April 2011 following advice from the President of the Court of Auditors in the context of a possible conflict of interests;
