Question No. 63 Mr. Robert Oliphant: With respect to the official provider of uniforms and clothing for the Vancouver 2010 Winter Games: (a) what was the selection process; (b) which companies submitted bids to provide these products to Canadian athletes and the Canadian public; (c) how was the decision made to select the Hudson’s Bay Corporation as the provider of official uniforms and clothing; (d) what consideration was provided for the selection of a Canadian owned company to provide the clothing; (e) what consideration was provided to companies who would manufacture the products fully in Canada; (f) what rationale can be provided for the selection of a foreign owned company who will produce the products outside of Canada; and (g) in the future, will there be an attempt from the government to further support the Canadian industry in the selection process for future Canadian Olympic clothing by selecting a Canadian company who will manufacture their product in Canada?

The four conditions are: (a) the beneficiary of a State funding mechanism for an SGEI must be formally entrusted with the provision and discharge of an SGEI, the obligations of which must be clearly defined; (b) the parameters for calculating the compensation must be established beforehand in an objective and transparent manner, to avoid it conferring an economic advantage which may favour the recipient undertaking over competing undertakings; (c) the compensation cannot exceed what is necessary to cover all or part of the costs incurred in the discharge of the SGEI, taking into account the relevant receipts and a reasonable profit for discharging those obligations; and (d) where the beneficiary is not chosen pursuant to a public procurement procedure, the level of compensation granted must be determined on the basis of an analysis of the costs which a typical undertaking, well run, would have incurred in discharging those obligations, taking into account the relevant receipts and a reasonable profit.

However, rather than providing for general exceptions and derogations for such enterprises, which might imply that they or their products are second-rate or sub-quality and which might result in a complex legal situation for the national market surveillance authorities to supervise, Community legislation should provide for the situation of such enterprises to be taken into account in setting the rules for the selection and implementation of the most appropriate conformity assessment procedures and concerning the obligations placed on conformity assessment bodies to operate in a proportionate manner in relation to the size of undertakings and to the small serial or non-serial nature of the production concerned.

Items for attention could include: improving awareness of entrepreneurship as a career option and building managerial skills of present or potential entrepreneurs throughout the education system in order to support the creation and development of businesses; women entrepreneurship and the setting-up of business by unemployed or inactive persons and young people; the reduction of administrative, tax or financial barriers to the hiring of staff, especially in innovative and small firms; awareness raising of the social responsibility of enterprises (Corporate Social Responsibility); assistance to enterprises in order to facilitate improvements in work organisation and working conditions, including in relation to the introduction of new technologies, for example through appropriate information and counselling.
