Conformément à l'article 16 du traité sur le fonctionnement de l'Union européenne et par dérogation à son paragraphe 2, le Conseil adopte une décision fixant les règles relatives à la protection des personnes physiques à l'égard du traitement des données à caractère personnel par les États membres dans l'exercice d'activités qui relèvent du champ d'application du présent chapitre, et à la libre circulation de ces données.
In accordance with Article 16 of the Treaty on the Functioning of the European Union and by way of derogation from paragraph 2 thereof, the Council shall adopt a decision laying down the rules relating to the protection of individuals with regard to the processing of personal data by the Member States when carrying out activities which fall within the scope of this Chapter, and the rules relating to the free movement of such data.

1. Les États membres prennent toute mesure supplémentaire nécessaire en vue de la bonne application du présent chapitre et se prêtent mutuellement assistance en vue de l'exécution des contrôles prévus par ledit chapitre.
1. The Member States shall take all further measures required for the proper application of this Chapter and shall give the mutual assistance needed for the purposes of checks required pursuant to this Chapter.

2 Dans le cadre de l'application du présent chapitre et de la partie A du Code ISPS, un Gouvernement contractant peut autoriser une installation portuaire donnée ou un groupe d'installations portuaires situées sur son territoire, autres que celles qui sont visées par un accord conclu en vertu de la règle 11, à mettre en oeuvre des mesures de sûreté équivalentes à celles qui sont prescrites dans le présent chapitre ou dans la partie A du Code ISPS, à condition que ces mesures de sûreté soient au moins aussi efficaces que celles qui sont prescrites dans le présent chapitre ou dans la partie A du Code ISPS.
2 When implementing this chapter and part A of the ISPS Code, a Contracting Government may allow a particular port facility or a group of port facilities located within its territory, other than those covered by an agreement concluded under regulation 11, to implement security measures equivalent to those prescribed in this chapter or in Part A of the ISPS Code, provided such security measures are at least as effective as those prescribed in this chapter or part A of the ISPS Code.
