2. 2. Foods not falling within the scope of Regulation (EC) No 258/97, which are lawfully placed on the market by 1 January 2018 and which fall within the scope of this Regulation may continue to be placed on the market until a decision is taken in accordance with Articles 10 to 12 or Articles 14 to 19 of this Regulation following an application for authorisation of a novel food or a notification of a traditional food from a third country submitted by the date specified in the implementing rules adopted in accordance with Article 13 or 20 of this Regulation respectively, but no later than 2 January 2020.

Therefore, food used solely as additives falling within the scope of Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives, flavourings falling within the scope of Regulation (EC) No 1334/2008 of the European Parliament and of the Council of 16 December 2008 on flavourings and certain food ingredients with flavouring properties for use in and on foods, extraction solvents falling within the scope of Directive 2009/32/EC of the European Parliament and of the Council of 23 April 2009 on the approximation of the laws of the Member States on extraction solvents used in the production of foodstuffs and food ingredients (recast), enzymes falling within the scope of Regulation (EC) No 1332/2008 of the European Parliament and of the Council of 16 December 2008 on food enzymes and genetically modified food falling within the scope of Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed should be excluded from the scope of this Regulation.

The relevant options as regards extending the scope to include direct debits are: (1) do not extend the scope of the Regulation to direct debits; (2) encourage industry self-regulation and/or recommend regulatory action by Member States and (3) enact legislation to extend the scope of the Regulation.

Food enzymes used exclusively in the production of food additives falling within the scope of Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives should be excluded from the scope of this Regulation, since the safety of these foods is already assessed and regulated.

(5) Food enzymes used exclusively in the production of food additives falling within the scope of ║Regulation (EC) No . of the European Parliament and of the Council of . [on food additives] , flavourings falling within the scope of ║Regulation (EC) No . of the European Parliament and of the Council of . [on flavourings and certain food ingredients with flavouring properties for use in and on foods ] ║and novel foods falling within the scope of Regulation (EC) No 258/97 of the European Parliament and of the Council of 27 January 1997 concerning novel foods and novel food ingredients should be excluded from the scope of this Regulation, since the safety of these foods is already assessed and regulated.
