TRADUCTIONS EN CONTEXTE

Compte tenu de la complexité des accords d’interopérabilité entre les contreparties centrales assurant la compensation de contrats dérivés de gré à gré, il convient, à ce stade, de prescrire un délai de grâce de trois ans entre l'octroi de l'autorisation de compensation applicable aux dérivés et le droit de demander l'agrément pour l'interopérabilité, ainsi que de restreindre le champ d’application des accords d’interopérabilité ultérieurs aux valeurs au comptant.
Given the additional complexities involved in an interoperability arrangement between CCPs clearing OTC derivative contracts, it is appropriate at this stage to require a grace period of three years between receiving clearing authorisation for derivatives and eligibility to apply for authorisation for interoperability as well as to restrict the scope of subsequent interoperability arrangements to cash securities.

2. Le présent règlement est applicable aux accords bilatéraux entre États membres et pays tiers concernant des questions sectorielles et portant sur le droit applicable en matière civile et commerciale, et relevant, entièrement ou partiellement, du champ d’application du règlement (CE) n° 593/2008 sur la loi applicable aux obligations contractuelles et du règlement (CE) n° 864/2007 sur la loi applicable aux obligations non contractuelles.
2. This Regulation shall apply to bilateral agreements between Member States and third countries concerning sectoral matters and covering applicable law in civil and commercial matters, and falling, entirely or partly, within the scope of Regulation (EC) No 593/2008 on the law applicable to contractual obligations and Regulation (EC) No 864/2007 on the law applicable to non-contractual obligations.

Takes note of the "Memorandum of Understanding" concluded between the Commission and China on 10 June 2005, with regard to the limitation of certain Chinese textile exports; however, calls on the Commission and the Council to extend the coverage of that agreement to other categories of textiles where necessary and to ensure transparency as to the basis for the calculation of the export limitations; insists that the safeguard clauses be applied in the event of an inappropriate application of the agreement;
