More precisely, the principal amendments introduced in the revised proposal consist of: Objective (1) making it clear that the proposal under discussion will not open up the EU market any further to suppliers from third countries (scope of the measure), notably by: clarifying the fields of application of the GPA and the Directives, as well as a clear statement as to the legal regime applicable to third country suppliers Objective (2) rewording the text concerning the technical dialogue in order to make it more flexible, notably by: replacing the earlier provision on "technical dialogue" by a recital and Objective (3) re-examining a number of amendments in order to remain as far as possible within the sectors covered by the GPA, notably by: limiting to the sectors covered by the GPA the obligation to inform eliminated candidates or tenderers of the reasons for their rejection and eliminated tenderers of the characteristics and advantages of the tender selected limiting the application of the changes in the thresholds to the contracts and sectors subject to the GPA limiting the amendments to the model notices, and in particular the notice on the existence of a qualification system (Annex XIII) and the periodic information notice (Annex XIV), to what is explicitly required by the GPA as is the case regarding the information to be provided by contracting entities when they invite candidates to confirm their interest following publication of a periodic indicative notice used as a means of calling for competition and introducing an obligation on the Commission to respect the commercially-sensitive nature of information communicated by contracting entities in notices on contracts awarded and concerning prices.

La communication des griefs adoptée par la Commission, le 24 mai 1996, envisage l'adoption par celle-ci d'une décision concernant les quatre restrictions de concurrence suivantes : (a) un accord portant sur les prix des services de transport maritime; (b) un accord portant sur les prix des services de transport terrestre fournis sur le territoire de la Communauté; (c) un accord entre les membres du TACA portant sur les termes et les conditions selon lesquels ils peuvent conclure des contrats de service avec les chargeurs; (d) un accord entre les membres du TACA relatif à la fixation de niveaux plafonnant les compensations consenties aux transitaires de transport; La communication des griefs propose de considérer, en première analyse : (i) que chacune des restrictions de concurrence entre dans le champ d'application de l'article 85(1) du Traité, (ii) que la demande d'exemption individuelle est refusée pour les pratiques se trouvant hors du champ d'application de l'exemption de groupe, (iii) que l'exemption de groupe est retirée en ce qui concerne les activités entrant dans son champ d'application.
On 24 May 1996, the Commission adopted a statement of objections which envisages the Commission adopting a decision addressing the following four restrictions of competition (a) the price agreement relating to maritime transport; (b) the price agreement relating to inland transport services supplied within the territory of the Community; (c) the agreement between the parties to the TACA as to the terms and conditions on and under which they may enter into service contracts with shippers; and (d) the agreement between the parties to the TACA relating to the fixing of maximum levels of freight forwarder compensation. It proposes, as a preliminary view, (i) that each of these practices is found to fall within the scope of Article 85(1), (ii) that application for individual exemption is refused for those practices falling outside the scope of the group exemption and (iii) that the group exemption is withdrawn in respect of the activities falling within its scope.
