Le présent protocole additionnel entre en vigueur pour un État ou une organisation régionale d'intégration économique qui le ratifie, l'accepte, l'approuve ou y adhère après le dépôt du quarantième instrument mentionné au paragraphe 1 ci-dessus, soit le quatre-vingt-dixième jour après la date de dépôt par cet État ou par cette organisation régionale d'intégration économique de son instrument de ratification, d'acceptation, d'approbation ou d'adhésion, ou à la date à laquelle le protocole entre en vigueur pour cet État ou pour cette organisation régionale d'intégration économique, la date la plus tardive étant retenue.
2. This Supplementary Protocol shall enter into force for a State or regional economic integration organization that ratifies, accepts or approves it or accedes thereto after the deposit of the fortieth instrument as referred to in paragraph 1 above, on the ninetieth day after the date on which that State or regional economic integration organization deposits its instrument of ratification, acceptance, approval, or accession, or on the date on which the Protocol enters into force for that State or regional economic integration organization, whichever shall be the later.

Provisional application by a State or regional economic integration organisation shall terminate upon the entry into force of this Agreement for that State or regional economic integration organisation or upon notification by that State or regional economic integration organisation to the Depositary in writing of its intention to terminate provisional application.

Dans les cas où une organisation d’intégration économique régionale qui est une organisation internationale au sens de l’article 1er de l’annexe IX de la convention n’a pas compétence pour toutes les questions relevant du présent accord, l’annexe IX à la convention s’applique mutatis mutandis à la participation de cette organisation au présent accord, à l’exception des dispositions suivantes de cette annexe:

In cases where a regional economic integration organisation that is an international organisation referred to in Annex IX, Article 1, of the Convention does not have competence over all the matters governed by this Agreement, Annex IX to the Convention shall apply mutatis mutandis to participation by such regional economic integration organisation in this Agreement, except that the following provisions of that Annex shall not apply:

This Protocol shall enter into force for a State or regional economic integration organization that ratifies, accepts or approves this Protocol or accedes thereto after the deposit of the fiftieth instrument as referred to in paragraph 1 above, on the ninetieth day after the date on which that State or regional economic integration organization deposits its instrument of ratification, acceptance, approval or accession, or on the date on which the Convention enters into force for that State or regional economic integration organization, whichever shall be the later.

En pareil cas, l’organisation régionale d’intégration économique aura les mêmes droits et obligations qu’un État contractant, dans la mesure où cette organisation a compétence sur des matières régies par cette convention.
The Regional Economic Integration Organisation shall in that case have the rights and obligations of a Contracting State, to the extent that the Organisation has competence over matters governed by this Convention.

3. Pour les fins de l’entrée en vigueur de la présente convention, tout instrument déposé par une organisation régionale d’intégration économique n’est pas compté, à moins que l’organisation régionale d’intégration économique ne déclare, en vertu de l’article 30, que ses États membres ne seront pas parties à cette convention.

For the purposes of the entry into force of this Convention, any instrument deposited by a Regional Economic Integration Organisation shall not be counted unless the Regional Economic Integration Organisation declares in accordance with Article 30 that its Member States will not be Parties to this Convention.

L’application provisoire de la présente convention par un État ou une organisation régionale d’intégration économique visée au paragraphe 1 du présent article prend fin dès l’entrée en vigueur de la présente convention pour cet État ou cette organisation régionale d’intégration économique, ou dès la notification au dépositaire par cet État ou cette organisation régionale d’intégration économique de son intention de mettre fin à son application provisoire de la présente convention.
