Les dispositions du règlement (CE) no 612/2009 de la Commission, du 7 juillet 2009, portant modalités communes d’application du régime des restitutions à l’exportation pour les produits agricoles, ainsi que celles des règlements (CE) no 376/2008 de la Commission, du 23 avril 2008, portant modalités communes d’application du régime des certificats d’importation, d’exportation et de préfixation pour les produits agricoles, et (CE) no 382/2008 de la Commission, du 21 avril 2008, portant modalités d’application du régime des certificats d’importation et d’exportation dans le secteur de la viande bovine, doivent être interprétées en ce sens qu’elles s’opposent, en principe, au paiement d’une restitution à l’exportation et à la libération de la garantie constituée à cet égard lorsque l’exportateur concerné ne disposait pas d’un certificat d’exportation valable à la date de l’acceptation de la déclaration d’exportation, alors même que l’exportation effective des marchandises concernées a eu lieu pendant la durée de validité du certificat d’exportation qui lui a été délivré.
The provisions of Commission Regulation (EC) No 612/2009 of 7 July 2009 on laying down common detailed rules for the application of the system of export refunds on agricultural products and of Commission Regulation (EC) No 376/2008 of 23 April 2008 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products and Commission Regulation (EC) No 382/2008 of 21 April 2008 on rules of application for import and export licences in the beef and veal sector must be interpreted as precluding, as a rule, the payment of an export refund and the release of the security lodged in that connection when the exporter concerned did not have a valid export licence at the date the export declaration was accepted, even though the actual export of the goods concerned took place during the period of validity of the export licence issued to it.

L’article 4, paragraphe 1, du règlement (CE) no 800/1999 de la Commission, du 15 avril 1999, portant modalités communes d’application du régime des restitutions à l’exportation pour les produits agricoles, tel que modifié par le règlement (CE) no 2299/2001 de la Commission, du 26 novembre 2001, lu en combinaison avec l’article 24 du règlement (CE) no 1291/2000 de la Commission, du 9 juin 2000, portant modalités communes d’application du régime des certificats d’importation, d’exportation et de préfixation pour les produits agricoles, doit être interprété en ce sens qu’il ne s’oppose pas à l’octroi de la restitution à l’exportation dans des circonstances particulières telles que celles de l’affaire au principal, où l’exportation a eu lieu en l’absence du certificat d’exportation, dont l’existence était toutefois établie au moment de la déclaration d’exportation et qui a été présenté, par l’exportateur, dans le délai supplémentaire d’une semaine accordé à cet effet par le bureau de douane compétent.
Article 4(1) of Commission Regulation (EC) No 800/1999 of 15 April 1999 laying down common detailed rules for the application of the system of export refunds on agricultural products, as amended by Commission Regulation (EC) No 2299/2001 of 26 November 2001, read in conjunction with Article 24 of Commission Regulation (EC) No 1291/2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products, must be interpreted as not precluding the grant of an export refund in specific circumstances such as those of the case in the main proceedings, in which the export took place without an export licence, whose existence was however established at the time the export declaration was made and which was presented, by the exporter, within the additional period of one week granted for that purpose by the competent customs office.

Specific implementing rules should be laid down for export licences in the pigmeat sector which should in particular include provisions for the submission of applications and the information which is to appear on the applications and licences, in addition to those contained in Commission Regulation (EC) No 376/2008 of 23 April 2008 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products (4).
