TRADUCTIONS EN CONTEXTE

Pour compléter les dispositions existantes relatives aux marques communautaires collectives et corriger le déséquilibre actuel entre les systèmes nationaux et le système de la marque de l'Union européenne, il est nécessaire d'ajouter une série de dispositions spécifiques visant à protéger les marques de certification de l'Union européenne, qui permettent à un institut ou organisme de certification d'autoriser les adhérents au système de certification à utiliser la marque en tant que signe pour des produits ou services satisfaisant aux critères de certification.
As a complement to the existing provisions on Community collective marks and to remedy the current imbalance between national systems and the EU trade mark system, it is necessary to add a set of specific provisions for the purpose of providing protection to European Union certification marks (‘EU certification marks’) which allow a certifying institution or organisation to permit adherents to the certification system to use the mark as a sign for goods or services complying with the certification requirements.

Annexes V and VII to the Agreement, as amended by Commission Implementing Decision (EU) 2015/1084 (8), establish new or revised measures on equivalence for certain live animals and animal products, lay down new or updated certification requirements, such as the model attestation for equivalent commodities, and that health certification may also occur electronically through use of the Union integrated electronic system established by Commission Decision 2003/24/EC (9) (‘TRACES’) after recording the EU's agreement for the exclusive use of electronic certification for consignments of live animals and animal products from New Zealand either in one of the Annexes to the Agreement or by correspondence in accordance with Article 16(1) of the Agreement.

Annex V to the Agreement provides that consignments of live animals and animal products for which equivalence has not been determined, may be imported into the Union when accompanied by the veterinary certificates laid down in accordance with the models set out in the relevant Union legislation on veterinary import certification or with the prevailing national health conditions of the Member States, pending adoption of harmonised Union rules in this respect.

Commission Regulation (EU) No 206/2010 of 12 March 2010 laying down lists of third countries, territories or parts thereof authorised for the introduction into the European Union of certain animals and fresh meat and the veterinary certification requirements (2) lays down amongst others the veterinary certification requirements for the introduction into the Union of certain consignments of live cloven-hoofed animals of the species listed in Annex I to Directive 2004/68/EC.

Registered horses intended for permanent imports into the European Union must have been resident in the country of dispatch for at least 90 days, or since birth, if they are less than 90 days old, or since entry, if they are imported directly from the European Union during the 90 days prior to certification for export to the European Union and they must have remained in the free area for at least 60 days or since birth, if they are less than 60 days old, or since entry, if they are imported directly into the free area from the European Union during the 60 days prior to certification for export to the European Union".
