34 (1) No pension shall be awarded under this Part to the surviving spouse or surviving common-law partner of any person in respect of the death of the person unless the surviving spouse or surviving common-law partner wholly or to a substantial extent maintained or was maintained by that person at the time of that person’s death and unless the surviving spouse or surviving common-law partner was that person’s spouse or common-law partner, as the case may be, prior to the day the war service injury in respect of which a pension is claimed was sustained.

(2) In any prosecution under this Act, it is sufficient proof of the offence to establish that it was committed by an employee or agent of the accused, whether or not the employee or agent is identified or has been prosecuted for the offence, unless the offence was committed without the accused's knowledge or consent and the accused exercised all due diligence to prevent the commission of the offence.

5. Si des sommes sont dues à un titulaire de droits pour des actes d’exploitation exécutés avant que la résiliation de l’autorisation ou le retrait des droits n’ait pris effet, ou dans le cadre d’une licence octroyée avant que cette résiliation ou ce retrait n’ait pris effet, ce titulaire conserve les droits que lui confèrent les articles 12, 13, 18, 20, 28 et 33.
5. If there are amounts due to a rightholder for acts of exploitation which occurred before the termination of the authorisation or the withdrawal of rights took effect, or under a licence granted before such termination or withdrawal took effect, the rightholder shall retain his rights under Articles 12, 13, 18, 20, 28 and 33.

Where the competent authority in the executing State has transmitted several notices referred to in Article 19(3) in respect of the same person to the competent authority in the issuing State, without this latter authority having taken any subsequent decision referred to in Article 18(1), the competent authority in the executing State may invite the competent authority in the issuing State to take such a decision, giving it a reasonable time limit to do so.
