La notion de raison impérieuse d'intérêt public à laquelle il est fait référence dans certaines dispositions du présent règlement est une notion évolutive élaborée par la Cour de justice dans sa jurisprudence relative aux articles 28 et 30 du traité.
The concept of overriding reasons of public interest to which reference is made in certain provisions of this Regulation is an evolving concept developed by the Court of Justice in its case law in relation to Articles 28 and 30 of the Treaty.

Unless justified by the subject-matter of the contract, technical specifications shall not refer to a specific make or source, or a particular process, or to trade marks, patents, types or a specific origin or production with the effect of favouring or eliminating certain undertakings or certain products.
