Si, dans les cinq ans à compter du dépôt de la première demande, une ou plusieurs demandes d'autorisation de mise sur le marché d'un produit contenant le même principe actif issu du même procédé de synthèse sont adressées aux autorités compétentes des autres États membres par le responsable de la mise sur le marché du produit original ou avec son consentement, ce dernier en informe immédiatement les autorités compétentes de l'État membre auquel a été adressée la première demande et le comité approprié est saisi pour avis.
If, within five years of the first application, one or more subsequent applications for authorization to place a product containing the same active principle derived from the same route of synthesis on the market are made to the competent authorities of the other Member States by the person responsible for placing the original product on the market or with his consent, that person shall forthwith in form the competent authorities of the Member State to whom the first application was made and the matter shall be brought before the appropriate Committee for an opinion.

Les États membres peuvent ne pas appliquer la période de six ans mentionnée ci-dessus au-delà de la date d'expiration d'un brevet protégeant le produit original.
Member States are at liberty not to apply the abovementioned six-year period beyond the date of expiry of a patent protecting the original product.
