IN-CONTEXT TRANSLATIONS

104. déplore le contenu de l'accord politique du 6 octobre 2015 au sein du Conseil, qui n'est pas à la hauteur de la proposition législative de la Commission présentée en mars 2015 modifiant la directive 2011/16/UE en ce qui concerne l'échange automatique et obligatoire d'informations dans le domaine fiscal; souligne que celle-ci prévoyait, en plus d'un cadre commun en matière d'enregistrement et d'échange automatique d'informations sur les rescrits, des dispositions permettant à la Commission d'en contrôler efficacement la mise en application par les États membres tout en veillant à ce que les rescrits ne portent pas préjudice au marché intérieur; souligne que l'adoption de la position du Conseil empêcherait de tirer pleinement parti de l'échange automatique d'informations sur les rescrits fiscaux, en particulier en termes de mise en œuvre effective, et invite donc le Conseil à s'en tenir à la proposition de la Commission et à tenir dûment compte de l'avis du Parlement sur le sujet, en particulier en ce qui concerne le champ d'application de la directive (tous les rescrits fiscaux et pas seulement les rescrits transfrontaliers), la période de rétroactivité (tous les rescrits fiscaux encore valides seraient échangés) et les informations à fournir à la Commission, qui devrait avoir accès aux rescrits fiscaux;

Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

(11) Il importe que les États membres prennent toutes les mesures nécessaires pour lever les obstacles qui pourraient entraver un échange automatique et obligatoire d’informations efficace et le plus large possible en ce qui concerne les décisions fiscales anticipées en matière transfrontière et les accords préalables en matière de prix de transfert, afin de renforcer la coopération et la transparence, compte tenu de la norme mondiale d'échange automatique de renseignements de l'OCDE comme norme minimale et du fait que les États membres se sont engagés à empêcher l'évasion fiscale en mettant en œuvre les modèles de publication d'informations financières par pays du G20-OCDE et en envisageant d'aller au-delà.
(11) Member States should take all measures necessary to remove any obstacle that might hinder the effective and widest possible mandatory automatic exchange of information on advance cross-border rulings and advance pricing arrangements in order to enhance cooperation and transparency, taking the global OECD standard for standard automatic exchange of information into consideration as a minimum standard and also the fact that Member States have committed to measures to prevent tax avoidance by implementing and considering going beyond G20-OECD models for country by country reporting.

(5) Afin que l'efficacité de ces échanges ne soit pas amoindrie, la possibilité que la transmission d'informations puisse être refusée dans le cas où elle conduirait à divulguer un secret commercial, industriel ou professionnel ou un procédé commercial, ou une information dont la divulgation serait contraire à l'ordre public ne devrait pas s'appliquer aux dispositions concernant l'échange automatique et obligatoire d'informations sur les décisions fiscales anticipées en matière transfrontière et les accords préalables en matière de prix de transfert.
(5) The possibility that the provision of information may be refused where it would lead to the disclosure of a commercial, industrial or professional secret or of a commercial process, or of information whose disclosure would be contrary to public policy should not apply to provisions of mandatory automatic exchange of information on advance cross-border rulings and advance pricing arrangements in order not to reduce the effectiveness of these exchanges.

l'autorité compétente de chaque État membre communique, par échange automatique, à l'autorité compétente de tout autre État membre, des informations sur les périodes d'imposition à compter du 1er janvier 2017 concernant les personnes résidant dans cet autre État membre, pour toutes les catégories de revenu et de capital visées au paragraphe 1, selon la manière dont elles doivent être qualifiées en vertu de la législation nationale de l'État membre qui communique les informations; et

As highlighted by the request of the European Council, it is appropriate to bring forward the extension of automatic information exchange already envisaged in Article 8(5) of Directive 2011/16/EU with respect to residents in other Member States.
