George Baker: I wonder if Senator Cowan could verify for us all the fact that this was an application under section 18.1 of the Federal Court Act that has exclusive jurisdiction in matters in which a decision of a cabinet minister is being appealed, and that the subject matter of this judgment was not the constitutionality of the impugned section but was, in fact, seeking a decision of the court that would declare only that what the minister has done is unlawful and should never be done by the federal government without consultation with those affected.
