A. considérant que l'entreprise commune Artemis ("l'entreprise commune") a été créée en décembre 2007 pour une durée de dix ans afin de définir et mettre en œuvre un "programme de recherche" pour le développement de technologies essentielles pour les systèmes informatiques embarqués dans différents domaines d'application afin de renforcer la compétitivité européenne et le développement durable et de permettre l'émergence de nouveaux marchés et de nouvelles applications sociétales;
A. whereas the ARTEMIS Joint Undertaking (" the Joint Undertaking") was set up in December 2007 for a period of 10 years to define and implement a “Research Agenda” for the development of key technologies for embedded computing systems across different application areas in order to strengthen European competitiveness and sustainability, and allow the emergence of new markets and societal applications,

10. prend note que la Commission réalisera une évaluation de l'activité d'Artemis jusqu'à la date de création de l'initiative technologique conjointe ECSEL, conformément au règlement (CE) nº 74/2008 du Conseil portant établissement de l'entreprise commune Artemis, évaluation qu'il y a lieu de prendre en considération dans la décharge de l'exercice 2014;
10. Takes note that the Commission will carry out an evaluation to assess the ARTEMIS activity up to the date of the ECSEL JTI creation, as provided for in Council Regulation (EC) No 74/2008 setting up the ARTEMIS Joint Undertaking, to be considered for the discharge for the financial year 2014;

The 13 institutions and bodies inspected were the Artemis Joint Undertaking, the Clean Sky Joint Undertaking, the Committee of the Regions, the Council of the European Union, the ENIAC Joint Undertaking, the European Anti-Fraud Office, the European Commission, the European Defence Agency, the European Economic and Social Committee, the European External Action Service, European Parliament; the Fuel Cells and Hydrogen Joint Undertaking and the Innovative Medicines Initiative.

5. rappelle que, selon le rapport d'audit de la Cour des comptes, les paiements effectués en 2012 et relatifs aux certificats de prise en charge émis par les autorités de financement nationales des États membres se sont élevées à 7,3 millions d'euros, soit 43 % du total des paiements opérationnels ; est préoccupé par le fait que, selon ce même rapport d'audit de la Cour des comptes, les rapports d'audit transmis par les autorités de financement nationales à l'entreprise commune Artemis couvrent environ 45 % des coûts relatifs aux projets achevés, que l'entreprise n'a pas évalué la qualité de ces audits, que, à fin avril 2013, les autorités de financement nationales n'avaient pas toutes fourni à l'entreprise commune les informations concernant les stratégies d'audit et qu'Artemis n'était donc pas en mesure de juger si les audits ex-post permettent d'obtenir une assurance suffisante quant à la légalité et à la régularité des opérations sous-jacentes;
5. Points out that, according to the audit report by the Court of Auditors, payments made in 2012 relating to certificates of acceptance of costs issued by the Member States' NFAs amounted to EUR 7,3 million, which represents 43% of total operational payments; is concerned that, according to that Court of Auditors' report, the Joint Undertaking received audit reports from the NFAs covering approximately 45% of the costs relating to completed projects, that the Joint Undertaking did not assess the quality of those audits, that, by the end of April 2013, the Joint Undertaking had not received information on the audit strategies of all NFAs, and that the Joint Undertaking was therefore not in a position to assess whether ex post audits provide sufficient assurance as to the legality and regularity of the underlying transactions;

16. rappelle que les entreprises communes Artemis et ENIAC ont été établies en décembre 2007 pour une période de dix ans dans le cadre du 7e programme-cadre de recherche en vue du développement de compétences essentielles, la première pour les systèmes informatiques embarqués et la deuxième pour la nanoélectronique; relève qu'Artemis a commencé à fonctionner de manière autonome en octobre 2009 et qu'ENIAC s'est vu accorder l'autonomie financière en juillet 2010;
16. Recalls that the Artemis and ENIAC Joint Undertakings were set up in December 2007, under the Seventh Framework Programme for a period of 10 years for the development of key competences for nanoelectronics and for the development of key technologies for embedded computing systems, respectively; notes that Artemis started to work autonomously in October 2009 and ENIAC was granted its financial autonomy in July 2010;

6. condamne le fait que la Grèce utilise des Fonds structurels de l'Union européenne pour financer ses contributions nationales aux bénéficiaires grecs des projets Artemis au lieu de recourir à des moyens de financement nationaux, et que l'entreprise commune ait accepté que la Grèce continue à participer aux projets Artemis, mais n'assure plus de financement aux bénéficiaires grecs, étant donné qu'un cofinancement par une autre source de financement de l'Union n'est pas autorisé, conformément au règlement (CE) n° 1083/2006 du Conseil; demande à la Commission d'informer l'autorité de décharge sur la légalité de la situation dès que possible;
6. Condemns the fact that Greece is using Union Structural Funds to cover its national contributions to the Greek beneficiaries of the Artemis projects instead of providing national funding and that the Joint Undertaking acknowledged the continuation of Greek participation in Artemis projects but provides no funding to the Greek beneficiaries as an expenditure co-financed by Union Structural Funds shall not receive assistance from another Union financial instrument in accordance with Council Regulation (EC) No 1083/2006; requests the Commission to inform the discharge authority on the legality of this situation as soon as possible;

La Commission européenne a approuvé aujourd'hui le rapport établi par un groupe d'experts indépendants qui appelle les entreprises et les États membres de l'UE à renforcer leur soutien aux initiatives ARTEMIS et ENIAC, deux partenariats public-privé (qui ont pris la forme d'entreprises communes) pour la recherche collaborative dans les domaines de la nanoélectronique et des systèmes intégrés (très utilisés dans l'industrie automobile, mais aussi dans les téléphones intelligents, les centrales électriques et d'autres applications). Les experts ont conclu que le modèle actuel de partenariat est bon pour les entreprises, bon pour les États membres et bon pour l'Europe. Cependant, ils ont aussi estimé que l'UE et les États membres doivent fournir davantage de ressources financières et que les entreprises doivent faire preuve d'un engagement plus marqué en faveur d'une stratégie européenne pour que le potentiel d'ARTEMIS et d'ENIAC puisse se réaliser pleinement. Stimuler la RD européenne dans les technologies de l'information et des communications est un des principaux objectifs de la stratégie numérique pour l'Europe (IP/10/581, MEMO/10/199 et MEMO/10/200).
The European Commission has today endorsed a report by a panel of independent experts which calls on EU industry and Member States to reinforce their support for ARTEMIS and ENIAC, two public-private partnerships (established as Joint Undertakings) for collaborative research in the fields of nanoelectronics and embedded systems (used widely in cars, smart phones, power plants and elsewhere. The experts concluded that the current partnership model is good for industry, good for Member States, and good for Europe. However, they also found that more financial resources are needed from EU Member States and that industry needs to demonstrate a stronger commitment towards a European strategy if ARTEMIS and ENIAC are to realise their full potential. Boosting European research and development in information and communications technologies is a key objective of the Digital Agenda for Europe (see IP/10/581, MEMO/10/199 and MEMO/10/200).

Since the establishment of the SESAR Joint Undertaking (Joint Undertaking), Council Regulation (EC) No 71/2008 of 20 December 2007 has set up the Clean Sky Joint Undertaking , Council Regulation (EC) No 72/2008 of 20 December 2007 set up the ENIAC Joint Undertaking , Council Regulation (EC) No 73/2008 of 20 December 2007 set up the Joint Undertaking for the implementation of the Joint Technology Initiative on Innovative Medicines , and Council Regulation (EC) No 74/2008 of 20 December 2007 set up the ARTEMIS Joint Undertaking to implement a Joint Technology Initiative in Embedded Computing Systems .

3. Tout paiement de l'entreprise commune Artemis destiné à couvrir la responsabilité mentionnée aux paragraphes 1 et 2 ainsi que les frais et dépenses exposés en relation avec celle-ci sont considérés comme dépenses de l'entreprise commune Artemis et sont couverts par les ressources de l'entreprise commune Artemis.
3. Any payment by the ARTEMIS Joint Undertaking in respect of the liability referred to in paragraphs 1 and 2 and the costs and expenses incurred in connection therewith shall be considered as expenditure of the ARTEMIS Joint Undertaking and shall be covered by the resources of the ARTEMIS Joint Undertaking.
