Firstly, inasmuch as it complains that the Court of First Instance held, in paragraphs 37 and 38 of the judgment under appeal, that the perception of the relevant public is not necessarily the same in the case of a three-dimensional trade mark, consisting of the appearance of the product itself, as in the case of a word or figurative mark, and that the average consumer perceives the shape of drinks packaging as an indication of the commercial origin of the product only if that shape is likely to be perceived from the outset as such an indication, that part of the plea is unfounded for the reasons set out in paragraphs 28 to 30 of the present judgment.

E. considérant que, le 17 octobre 2005, Rassoul Gouliev, l'une des figures-clés de l'opposition qui s'est déclaré candidat aux élections, a été temporairement détenu en Ukraine alors qu'il tentait de rejoindre Bakou, en raison d'un mandat d'arrêt international délivré par l'Azerbaïdjan en raison d'une accusation de détournement de fonds et considérant que les 16 et 17 octobre 2005, la police d'Azerbaïdjan a placé en détention 200 activistes de l'opposition et arrêté beaucoup d'entre eux dans le contexte de son projet de retour à Bakou;
E. whereas on 17 October 2005 Rasul Guliyev, a leading opposition figure who has registered as a candidate in the elections, was temporarily detained in Ukraine on his way back to Baku pursuant to an international warrant issued by Azerbaijan alleging embezzlement, and whereas on 16 and 17 October 2005 Azerbaijani police detained around 200 opposition activists and arrested many of them in connection with his proposed return to Baku,
