(4) For the purposes of the description of A in subsection (3), an individual’s redetermined benefit entitlement under a defined benefit provision of a registered pension plan in respect of a calendar year and an employer, determined as of a particular time, is the amount that would be determined under section 8302 to be the individual’s benefit entitlement under the provision in respect of the year and the employer if, for the purpose of computing the benefit accrual of the individual in respect of the year under the provision and, where subsection 8302(6) is applicable, under any other defined benefit provision, the amount determined under paragraph 8302(2)(a) in respect of a specific provision were equal to that portion of the individual’s normalized pension (computed in accordance with subsection (5)) under the specific provision at the particular time, determined with reference to the year, as may reasonably be considered to have accrued in respect of the year.

In particular, delegated acts should be adopted in respect of lawfulness of processing ; specifying the criteria and conditions in relation to the consent of a child; processing of special categories of data; specifying the criteria and conditions for manifestly excessive requests and fees for exercising the rights of the data subject; criteria and requirements for the information to the data subject and in relation to the right of access; the right to be forgotten and to erasure; measures based on profiling ; criteria and requirements in relation to the responsibility of the controller and to data protection by design and by default; a processor; criteria and requirements for the documentation and the security of processing; criteria and requirements for establishing a personal data breach and for its notification to the supervisory authority , and on the circumstances where a personal data breach is likely to adversely affect the data subject; the criteria and conditions for processing operations requiring a data protection impact assessment; the criteria and requirements for determining a high degree of specific risks which require prior consultation; designation and tasks of the data protection officer; codes of conduct; criteria and requirements for certification mechanisms; criteria and requirements for transfers by way of binding corporate rules; transfer derogations; administrative sanctions; processing for health purposes; processing in the employment context and processing for historical, statistical and scientific research purposes .

(19) Afin de compléter ou de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l'Union européenne en ce qui concerne l'établissement des processus de production pour obtenir des produits vinicoles aromatisés, les critères de la délimitation de la zone géographique et les règles, restrictions et dérogations concernant la production dans lesdites aires, les conditions dans lesquelles le cahier des charges d'un produit peut inclure des exigences supplémentaires, la détermination des cas dans lesquels un producteur isolé peut solliciter la protection d'une indication géographique et les restrictions applicables au type de demandeur qui peut solliciter ladite protection; l'établissement des conditions à respecter dans le cadre d'une demande de protection d'une indication géographique, l'examen par la Commission, la procédure d'opposition et les procédures de modification et d'annulation des indications géographiques; l'établissement des conditions applicables aux demandes transfrontalières; la fixation de la date de présentation d'une candidature ou d'une demande, la date à partir de laquelle la protection s'applique et la date à laquelle la modification d'une protection s'applique; l'établissement des conditions dans lesquelles une modification est considérée comme mineure, et les conditions à respecter concernant la demande et l'approbation d'une modification lorsque cette modification n'implique aucun changement au document unique; les restrictions à propos de la dénomination protégée; la nature et le type d'informations à notifier dans le cadre de l'échange d'informations entre les États membres et la Commission, les méthodes de notification, les règles relatives au droit d'accès à l'information ou aux systèmes d'information mis à disposition et les modalités de publication des informations.
(19) In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the TFEU should be delegated to the Commission in respect of the establishment of production processes for obtaining aromatised wine products; criteria for the demarcation of geographical areas and rules, restrictions and derogations related to production in such areas; the conditions under which a product specification may include additional requirements; the determination of the cases in which a single producer may apply for the protection of a geographical indication and the restrictions governing the type of applicant that may apply for such protection; the establishment of the conditions to be complied with in respect of an application for the protection of a geographical indication, scrutiny by the Commission, the objection procedure and procedures for amendment and cancellation of geographical indications; the establishment of the conditions applicable to trans-border applications; the setting of the date for the submission of an application or a request, the date from which the protection applies and the date on which an amendment to a protection applies; the establishment of the conditions relating to amendments to product specifications, including the conditions when an amendment is considered minor and the conditions relating to the applications for, and approval of, amendments, which do not involve any change to the single document; the restrictions regarding the protected name; the nature and type of information to be notified in the exchange of information between Member States and the Commission, the methods of notification, the rules related to the access rights to information or information systems made availableandand the modalities of publication of the information.

(14) Afin de faciliter la procédure applicable aux demandes successives, il devrait être possible de copier les données biométriques de la première demande lorsqu'il s'est écoulé moins de 59 mois à compter du début de la période de conservation des données prévue à l'article 23 du règlement VIS.
(14 ) In order to facilitate the procedure of any subsequent application, it should be possible to copy biometric data from the first application within a period of 59 months from the start of the retention period provided for in Article 23 of the VIS Regulation.

(11) Afin de faciliter la procédure applicable aux demandes successives, il devrait être possible de copier les données biométriques de la première demande lorsqu'il s'est écoulé moins de 48 mois entre celle-ci et la nouvelle demande, conformément à la période de conservation des données fixée dans le règlement VIS.
(11) In order to facilitate the procedure of any subsequent application, it should be possible to copy biometric data from the first application within a period of 48 months in accordance with the retention period laid down in the VIS Regulation.
