"Conditions" and "obligations" is wording normally used for delegated acts - not for implementing acts as the ones in points (a) and (b) above. The amendment seeks to clarify the precise rules and obligations on the basis of the factual content of those provisions originating from Articles 1 and 3 of Regulation 760/2008.

(10) Le présent règlement constitue un développement du système d'information Schengen aux fins de son application eu égard aux dispositions de l'acquis de Schengen relatives à la circulation des personnes; le Royaume-Uni n'a pas demandé à participer au système d'information Schengen et n'y participe pas à ces fins, conformément à la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen(5); le Royaume-Uni ne participe donc pas à l'adoption de cet acte et n'est pas lié par celui-ci ni soumis à son application.
(10) This Regulation constitutes a development of the SIS for the purpose of its application in relation to provisions of the Schengen acquis relating to the movement of persons; the United Kingdom has not applied to and does not take part in the SIS for these purposes, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis(5); the United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.
