He proposed that the Court give the following answers to the questions referred by the Belgian Hof van Cassatie: 1. Neither the provisions of the First Council Directive 80/1263/EEC of 4 December 1980 on the introduction of a Community driving licence, in particular Article 8 thereof, nor the provisions of the EC Treaty preclude the driving of a motor vehicle by a person who is not a European Union citizen but who holds a national driving licence or a Community model licence issued by a Member State, and who in exchange for his licence could have obtained a licence of the State in which he has settled but has not made that exchange within the prescribed period, from being treated as driving without a licence and thus rendered punishable by imprisonment or a fine.

He proposed that the Court should reply as follows: '1. L’article premier du projet de loi modifie l’alinéa 5(3)a) de la LRCDAS pour qu’il prévoie, dans certains cas, des peines minimales obligatoires d’emprisonnement pour une infraction relative au trafic d’une substance inscrite à l’annexe I, ou d’une substance inscrite à l’annexe II si sa quantité excède celle fixée à l’annexe VII. Une peine minimale d’emprisonnement d’un an s’appliquera dans certaines circonstances aggravantes, soit : l’infraction a été commise pour le compte d’une organisation criminelle, au sens du paragraphe 467.1(1) du Code (un groupe d’au moins trois personnes dont l’objet est de commettre une infraction grave pour obtenir un avantage matériel); la personne a eu recours ou a menacé de recourir à la violence pour la perpétration de l’infraction; la personne portait ou a utilisé ou a menacé d’utiliser une arme pour la perpétration de l’infraction; ou la personne a été déclarée coupable d’une infraction désignée et a purgé une peine d’emprisonnement d’un an ou plus relativement à cette infraction au cours des 10 dernières années(59). Une « infraction désignée » est définie à l’article 2 de la LRCDAS comme toute infraction prévue aux articles 4 à 10 de cette loi, sauf la possession d’une substance inscrite à l’annexe I, II ou III de la même loi de la façon prévue par son paragraphe 4(1).
Clause 1 of Bill C-15 amends section 5(3)(a) of the CDSA to provide in certain circumstances for mandatory minimum terms of imprisonment for the offence of trafficking in a substance included in Schedule I or in Schedule II if the amount of the Schedule II substance exceeds the amount for that substance set out in Schedule VII. There will be a minimum punishment of imprisonment for one year if certain aggravating factors apply: the offence was committed for a criminal organization, as that term is defined in section 467.1(1) of the Criminal Code (a group of three or more people whose purpose is to commit serious offences for material benefit); there was the use or threat of the use of violence in the commission of the offence; a weapon was carried, used or threatened to be used in the commission of the offence; or the offender was convicted of a designated substance offence within the previous 10 years and had served a term of imprisonment of one year or more for that offence (59) A “designated substance offence” is defined in section 2 of the CDSA to mean any of the offences in sections 4 to 10 of the CDSA, except the offence of possession of a substance found in Schedule I, II, or III to the Act, as set out in subsection 4(1).
