have a real "incentive effect", in other words it must effectively encourage the beneficiary to invest in a specific disadvantaged region; be kept to the minimum necessary to attract the investment to the disadvantaged region; not have undue negative effects, such as creation of excess capacity by the aided investment in a declining market; not exceed the regional aid ceiling applicable to the region in question; not directly cause the relocation of existing or closed down activities from elsewhere in the EU to the aided establishment; and not divert investment away from another region in the EU which has the same, or lower, level of economic development than the region where the aided investment takes place.

Les aides régionales à l'investissement accordées en faveur de grands projets d'investissement sont notifiées à la Commission si le montant total d’aides de toutes les sources dépasse 75 % du montant maximum d'aide qu'un investissement dont les coûts admissibles sont de 100 millions d'euros peut recevoir selon le seuil applicable aux grandes entreprises prévu dans la carte des aides à finalité régionale approuvée à la date d'octroi de l'aide.
2. Regional investment aid awarded in favour of large investment projects shall be notified to the Commission if the total amount of aid from all sources exceeds 75 % of the maximum amount of aid an investment with eligible costs of EUR 100 million could receive, applying the standard aid threshold in force for large enterprises in the approved regional aid map on the date the aid is to be granted.
