Par lettre du 9 décembre 2011 (5), la Commission a fait part à l'Autriche de sa décision d'ouvrir la procédure visée à l'article 108, paragraphe 2, du traité sur le fonctionnement de l'Union européenne (ci-après le «TFUE») en raison de l'injection de capital à hauteur de 1 milliard d'EUR et de la garantie d'un montant de 3 milliards d'EUR accordées par l'Autriche à ÖVAG et l'a invitée à soumettre un plan de restructuration modifié, dont la version définitive a été présentée le 4 septembre 2012 (ci-après le «plan de restructuration de 2012»).
By letter dated 9 December 2011 (5), the Commission informed Austria that it had decided to initiate the procedure laid down in Article 108(2) of the Treaty on the Functioning of the European Union (‘the Treaty’) in respect of the recapitalisation of EUR 1 billion and the guarantee of EUR 3 billion granted by Austria to ÖVAG, and requested Austria to submit an amended restructuring plan, the final version of which was submitted on 4 September 2012 (‘the 2012 restructuring plan’).

The Republic of Austria hereby provides the following commitments concerning Österreichische Volksbanken-Aktiengesellschaft (“ÖVAG”) and the Volksbanken-Verbund, represented by Volksbank Wien-Baden AG (“VBWB”) in its capacity as the new central organisation of the Verbund, in order that the European Commission, by decision under Article 107(3)(b) of the Treaty on the Functioning of the European Union (“TFEU”), may find the aid granted to ÖVAG compatible with the internal market.

Any change in the uniform rate of the VAT-based own resource, in the rate of the GNI-based own resource, in the correction granted to the United Kingdom for budgetary imbalances and in its financing referred to in Article 4 and 5 of Decision 2014/335/EU, Euratom, and in the financing of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden shall require the final adoption of an amending budget and shall give rise to readjustments of the twelfths which have been entered since the beginning of the financial year.

For the specific needs of paying expenditure of the EAGF pursuant to Regulation (EC) No 73/2009, and depending on the Union's cash position, Member States may be invited by the Commission to bring forward by one or two months in the first quarter of the financial year the entry of one-twelfth or a fraction of one-twelfth of the amounts in the budget for the VAT-based own resource and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden.

3. The VAT-based own resource and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden, shall be credited on the first working day of each month, the amounts being one-twelfth of the relevant totals in the budget, converted into national currencies at the rates of exchange of the last day of quotation of the calendar year preceding the budget year, as published in the Official Journal of the European Union, C Series.

If the budget has not been finally adopted at the latest two weeks before the entry for January of the following financial year, the Member States shall enter on the first working day of each month, including January, one-twelfth of the amount of the VAT-based own resource, and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden, entered in the last budget finally adopted; the adjustment shall be made on the first due date following final adoption of the budget if it is adopted before the sixteenth of the month.

Par lettre du 27 juin 2012 et conformément à l’article 114, paragraphe 4, du traité sur le fonctionnement de l’Union européenne (TFUE), l’Autriche a notifié à la Commission son intention de maintenir ses dispositions nationales concernant certains gaz industriels à effet de serre, qui sont plus strictes que celles du règlement (CE) no 842/2006 du Parlement européen et du Conseil du 17 mai 2006 relatif à certains gaz à effet de serre fluorés (1), au-delà du 31 décembre 2012, date d’expiration de l’autorisation accordée par la décision 2008/80/CE de la Commission du 21 décembre 2007 concernant les dispositions nationales relatives à certains gaz à effet de serre fluorés notifiées par la République d’Autriche (2) adoptée conformément à l’article 95, paragraphe 6, du traité instituant la Communauté européenne (TCE) (devenu article 114, paragraphe 6, du TFUE).
By letter of 27 June 2012 and pursuant to Article 114(4) of the Treaty on the Functioning of the European Union (TFEU) Austria notified the Commission that Austria intends to maintain its national provisions on certain industrial greenhouse gases which are more stringent than Regulation (EC) No 842/2006 of the European Parliament and of the Council of 17 May 2006 on certain fluorinated greenhouse gases (1) beyond 31 December 2012, the end date of the authorisation by Commission Decision 2008/80/EC of 21 December 2007 concerning national provisions notified by the Republic of Austria on certain fluorinated greenhouse gases (2), adopted in accordance with Article 95(6) of the Treaty establishing the European Community (TEC) (now Article 114(6) TFEU).

By letter registered with the Secretariat-General of the Commission on 2 June 2009, the Republic of Austria (hereinafter Austria) requested an authorisation to continue to apply a measure derogating from the provisions of Directive 2006/112/EC governing the right of deduction and previously granted by Decision 2004/866/EC (2) under the then applicable Sixth Directive 77/388/EC of 17 May 1977 on the harmonisation of the laws of the Member States relating to turnover taxes — Common system of value added tax: uniform basis of assessment (3).
