[11] Cinq objectifs ont été fixés: 1) le règlement acceptable et durable de la question de la répartition des biens publics entre l'État et les autres niveaux de pouvoir; 2) le règlement acceptable et durable de la question des biens militaires; 3) l'application complète de la sentence définitive du tribunal d'arbitrage sur Brčko; 4) la viabilité budgétaire; et 5) l'ancrage de l'État de droit (démontré par l'adoption d'une stratégie nationale concernant les crimes de guerre, d'une loi sur l'accueil des étrangers et le droit d'asile, et d'une stratégie nationale de réforme du secteur judiciaire), ainsi que deux conditions spécifiques: 1) la signature de l'accord de stabilisation et d'association et 2) une situation politique stable.
[11] These cover 5 objectives: 1) Acceptable and sustainable resolution of the issue of apportionment of property between State and other levels of government; 2) Acceptable and sustainable resolution of defence property; 3) Completion of the Brčko Final Award; 4) Fiscal sustainability; and 5) Entrenchment of the rule of law (demonstrated by adoption of a National War Crimes Strategy, of a Law on Aliens and Asylum and of a National Justice Sector Reform Strategy), as well as two specific conditions: 1) signing of the Stabilisation and Association Agreement 2) a stable political situation.

After examining the documents supplied by the Commission, the Tribunal decided, by order of 18 April 2013, to place the general guide on the file and to send the detailed guide back to the Commission, on the ground that, having read the guide the Tribunal did not consider that this was necessary for it to rule on the merits of the pleas put forward by the applicant in the present case; to agree to the Commission’s request for confidentiality regarding the marking profile, and to make communication to the applicant of the general guide and the non-confidential version of the marking profile subject to confidential treatment and to certain conditions.

This Decision shall enter into force after the notification to the Council by the last Member State of its acceptance of this Decision on the date of the publication in the Official Journal of the European Union of the ruling by the President of the Court of Justice that the Community Patent Court and the patent appeal chamber within the Court of First Instance have been constituted in accordance with law.

[9] These cover five objectives: 1) Acceptable and sustainable resolution of the issue of apportionment of property between State and other levels of government; 2) Acceptable and sustainable resolution of defence property; 3) Completion of the Brcko final awards; 4) Fiscal sustainability (promoted by an agreement on a permanent ITA coefficient methodology and establishment of a National Fiscal Council); and 5) Entrenchment of the rule of law (demonstrated by adoption of a National War Crimes Strategy, of a Law on aliens and asylum and of a National Justice Sector Reform Strategy), as well as two specific conditions: 1) signing of the SAA and 2) a stable political situation.

7. Si le tribunal estime qu'il y a eu violation du présent accord et que la partie responsable de cette violation n'y remédie pas ou ne parvient pas, dans les quarante jours suivant la notification de la décision du tribunal, à un accord mutuellement acceptable avec l'autre partie, cette dernière peut suspendre l'application d'avantages comparables découlant du présent accord, jusqu'à ce que les parties parviennent à régler le différend.
7. If the tribunal determines that there has been a violation of this Agreement and the responsible Party does not cure the violation, or does not reach agreement with the other Party on a mutually satisfactory resolution within 40 days after notification of the tribunal's decision, the other Party may suspend the application of comparable benefits arising under this Agreement until such time as the Parties have reached agreement on a resolution of the dispute.
