I. whereas it is essential to evaluate the Member States' compliance with the Schengen acquis in order to ensure the smooth functioning of the Schengen area; whereas the evaluation mechanism based on the Schengen Evaluation Working Group (SCH-EVAL), a purely intergovernmental body, has not proven sufficiently effective,

La Bulgarie et la Roumanie sont à présent en mesure de mettre en œuvre cet acquis Schengen en termes techniques et en termes de personnel.
Bulgaria and Romania are now in a position to implement the Schengen acquis in terms of their technical capacity and human resources.

Reminds the Member States that they should put in place as soon as possible all the necessary measures to remedy the remaining shortcomings , but notes that, although some issues are still outstanding and will require follow-up in the future, they do not constitute an obstacle to applying the full Schengen acquis to the new Member States concerned;

Welcomes the inclusion of the Nordic countries in the Schengen area with guarantees of the integrity of both the Nordic Passport Union and of the Schengen area; believes, however, that the inclusion in the Schengen area of the countries of the Nordic Passport Union may constitute an obstacle to any future communitization of the Schengen acquis and therefore calls for clear legal arrangements so as to overcome institutional objections;
