In accordance with Article 6a of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, as annexed to the TEU and to the TFEU, the United Kingdom and Ireland are not bound by the rules laid down in this Directive which relate to the processing of personal data by the Member States when carrying out activities which fall within the scope of Chapter 4 or Chapter 5 of Title V of Part Three of the TFEU where the United Kingdom and Ireland are not bound by the rules governing the forms of judicial cooperation in criminal matters or police cooperation which require compliance with the provisions laid down on the basis of Article 16 TFEU.

Instructs its President to forward this resolution to the Commission, the Council, the governments and parliaments of the Member States and candidate countries, the UN Secretary-General, the Secretary-General of the Organization for Security and Co-operation in Europe, the International Committee of the Red Cross, the International Campaign to Ban Landmines , Geneva Call, the ACP-EU Joint Parliamentary Assembly, the Governments of the United States of America, the Russian Federation, the People's Republic of China, Pakistan and India and the President-Designate of the Ninth Meeting of the States Parties to the Ottawa Convention and of the Second Review Conference.

The United Kingdom and Ireland shall not be bound by the rules laid down on the basis of Article 16 of the Treaty on the Functioning of the European Union which relate to the processing of personal data by the Member States when carrying out activities which fall within the scope of Chapter 4 or Chapter 5 of Title V of Part Three of that Treaty where the United Kingdom and Ireland are not bound by the rules governing the forms of judicial cooperation in criminal matters or police cooperation which require compliance with the provisions laid down on the basis of Article 16.
