The operating rules of the European Investment Bank (EIB), the European Union’s financing institution, are laid down in Protocol (No 5) annexed to the Treaty on European Union and the Treaty on the Functioning of the EU.

Conformément au protocole no 5 sur les statuts de la Banque européenne d'investissement annexé au traité sur l'Union européenne et au traité sur le fonctionnement de l'Union européenne, les demandes adressées directement à la BEI pour ses opérations de financement à mener au titre de la présente décision doivent être soumises à la Commission pour avis sur leur conformité avec la législation et les politiques de l'Union concernées.
In accordance with Protocol No 5 on the Statute of the European Investment Bank annexed to the Treaty on European Union (TEU) and the TFEU, applications made directly to the EIB for EIB financing operations to be carried out under this Decision are to be submitted to the Commission for an opinion on the conformity with relevant Union legislation and policies.

7. Sans préjudice de l'application de l'article 216 du traité instituant la Communauté européenne, de l'article 77 du traité instituant la Communauté européenne du charbon et de l'acier, de l'article 189 du traité instituant la Communauté européenne de l'énergie atomique et de l'article 1er, deuxième alinéa, du protocole sur les statuts de la Banque européenne d'investissement, les représentants des gouvernements des États membres arrêtent d'un commun accord les dispositions nécessaires en vue de régler certains problèmes particuliers au Grand-Duché de Luxembourg et qui résultent de la création d'un Conseil unique et d'une Commission unique des Communautés européennes.
7. Without prejudice to the application of Article 216 of the Treaty establishing the European Community, Article 77 of the Treaty establishing the European Coal and Steel Community, Article 189 of the Treaty establishing the European Atomic Energy Community and the second paragraph of Article 1 of the Protocol on the Statute of the European Investment Bank, the representatives of the Governments of the Member States shall adopt by common accord the necessary provisions for the purpose of dealing with certain problems particular to the Grand Duchy of Luxembourg which arise from the creation of a Single Council and a Single Commission of the European Communities.
