Le chapitre II contient les amendements à apporter au statut de la Cour de justice pour permettre au Tribunal de première instance d'agir en tant qu'instance d'appel dans le contentieux du brevet communautaire. Il prévoit la mise en place d'une chambre d'appel spécialisée en matière de brevets au sein du Tribunal de première instance ainsi que les dispositions spécifiques régissant la procédure devant celle-ci.
