Objet: Recours, introduit au titre de l’article 270 TFUE, applicable au traité CEEA en vertu de son article 106 bis, par lequel BN demande, d’une part, l’annulation de la décision du Parlement européen du 20 mars 2012 mettant fin à ses fonctions de conseiller auprès du directeur de la direction des ressources de la direction générale (DG) du personnel et la réaffectant, avec effet au 15 mars 2012, à un poste de conseiller auprès du service « Système de management environnemental et d’audit » de l’unité de coordination générale de la direction des ressources de la DG des infrastructures et de la logistique (ci-après le « service EMAS ») ainsi que de la décision du 21 septembre 2012 rejetant la réclamation introduite contre la décision du 20 mars 2012 et, d’autre part, la réparation du préjudice subi du fait d’agissements de harcèlement et de mauvaise administration de la part de sa hiérarchie, chiffré ex æquo et bono à la somme de 400 000 euros.

Although the concept of pay within the meaning of Article 141 of the Treaty does not encompass social security benefits, it is now clearly established that a pension scheme for public servants falls within the scope of the principle of equal pay if the benefits payable under the scheme are paid to the worker by reason of his/her employment relationship with the public employer, notwithstanding the fact that such scheme forms part of a general statutory scheme.
