B. G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;

15. souligne que le Parlement s'est engagé à mettre en place un service d'audit interne indépendant conformément au règlement (CE, CECA, Euratom) n° 762/2001 du Conseil modifiant l'article 24 du règlement financier; prend note de la décision du Bureau, du 28 novembre 2001, tendant à mettre en place un tel service; insiste sur le fait que ce service doit être indépendant, tout en ayant la faculté de communiquer directement avec le Président du Parlement lorsque l'attention de l'auditeur interne est attirée sur des problèmes graves; invite instamment le Bureau à approuver d'urgence les modifications nécessaires des dispositions financières internes; est d'avis que l'auditeur interne doit être un professionnel de l'audit hautement qualifié et disposant d'une vaste expérience, qui soit en mesure d'exercer ses fonctions de manière tout à fait indépendante et dans le respect des normes internationales en la matière; estime que l'expérience récente de certaines banques et groupes importants, qui ont subi des pertes catastrophiques à cause de lacunes en matière de contrôle interne, montre que l'affaiblissement des mécanismes de contrôle serait préjudiciable à la bonne gestion des deniers du contribuable européen; demande avec insistance que soit garantie l'indépendance des contrôleurs et des fonctions de contrôle à l'égard des responsables des dépenses;
15. Underlines Parliament's commitment to establish an independent internal audit service in accordance with Council Regulation (EC, ECSC, Euratom) No 762/2001 amending Article 24 of the Financial Regulation ; notes the Bureau decision of 28 November 2001 to set up such a service; stresses that the service must be independent with the possibility of communicating directly to the President of Parliament when issues of gravity come to the attention of the internal auditor; urges the Bureau to approve the necessary changes to its Internal Financial Rules as a matter of priority; considers that the internal auditor must be a highly qualified and experienced audit professional who is able to perform his duties in a fully independent manner and in accordance with the relevant international standards; believes that the recent experiences of certain banks and large conglomerates, which suffered catastrophic losses due to weak internal controls show that the weakening of control mechanisms would be detrimental to the sound management of European taxpayer's money; insists that the independence of controllers and of the control function be safeguarded from being subordinated to expenditure managers;

Motion no 9 Qu'on modifie le projet de loi C-67, à l'article 47, par adjonction, après la ligne 29, page 14, de ce qui suit: «7 (1) Est prorogé le Bureau de services juridiques des pensions, qui relève du ministre et est composé d'un avocat-conseil en chef nommé par le gouverneur en conseil et des autres avocats-conseils, cadres et employés nécessaires à l'exercice des fonctions du Bureau (2) L'avocat-conseil en chef et les autres avocats- conseils sont choisis parmi les membres du Barreau d'une province (3) L'avocat-conseil en chef est le premier dirigeant du Bureau; à ce titre, il assure la surveillance et la direction des travaux des avocats-conseils et des autres membres du personnel du Bureau. 8. Le Bureau ne fait pas partie du ministère; toutefois, il présente au ministre les rapports que celui-ci peut exiger.
Motion No. 9 That Bill C-67, in Clause 47, be amended by adding after line 33, on page 14, the following: ``7 (1) There is hereby continued under the Minister a bureau to be known as the Bureau of Pensions Advocates, consisting of a Chief Pensions Advocate appointed by the Governor in Council and such other pensions advocates, officers and employees as may be required for the performance of the duties of the Bureau (2) The Chief Pensions Advocate and each pensions advocate shall be appointed from among persons who are members of the bar of any province (3) The Chief Pensions Advocate is the chief executive officer of the Bureau and has supervision over and direction of the work of the pensions advocates and other staff of the Bureau. 8. The Bureau is not part of the Department but it shall make such reports to the Minister as the Minister may direct.
