De plus, l’approche selon laquelle, dans le cas où le poste en cause a déjà été pourvu au moment de l’introduction du recours, la demande d’annulation de la décision de rejet de la candidature ne serait recevable que si le candidat évincé demande parallèlement l’annulation de la décision de nomination d’un autre candidat sur le poste en cause aboutirait à introduire une condition de recevabilité, non prévue par le statut, en ce qui concerne les recours portant sur la légalité d’un acte faisant grief au sens de l’article 90, paragraphe 2, du statut. Pour qu’une personne entrant dans le champ d’application du statut soit recevable, dans le cadre d’un recours introduit au titre des articles 90 et 91 dudit statut, à demander l’annulation d’un acte lui faisant grief, au sens de l’article 90, paragraphe 2, celle-ci doit posséder, au moment de l’introduction du recours, un intérêt, né et actuel, suffisamment caractérisé à voir annuler cet acte, un tel intérêt supposant que la demande soit susceptible, par son résultat, de lui procurer un bénéfice. En tant que condition de recevabilité, l’intérêt du requérant à agir doit s’apprécier au moment de l’introduction du recours.
In order for a person to whom the Staff Regulations apply to be permitted, in an action pursuant to Articles 90 and 91 of the Staff Regulations, to request annulment of an act adversely affecting him, within the meaning of Article 90(2), he must at the time of bringing the action have a vested and present and sufficiently clear interest in obtaining the annulment of that act and such an interest presumes that the claim should be capable, by its result, of securing an advantage for him. As a condition of admissibility, the applicant’s interest in bringing proceedings must be evaluated at the time when the action is brought.

Le Conseil a également pris connaissance du fait que la Turquie a l'intention d'attendre la décision de la Cour européenne des droits de l'homme qui, le 30 septembre 1999, a demandé à la Turquie "de prendre toutes les mesures nécessaires pour que la peine capitale ne soit pas exécutée afin que la Cour puisse poursuivre efficacement l’examen de la recevabilité et du fond des griefs que le requérant formule sur le terrain de la Convention".
